Of course he's the victim. She killed him for no good reason...

Travis wanted to be a "good" Mormon and made a point to portray himself as one. I'm not saying the alternative is to go around bragging about your conquests. Of course your private life isn't anyone else's business. I'm sure you don't run around teaching people chastity as if you practice it yourself tho either
Please don't take offense. Since we were asked to focus on what is happening in the re-trial, I won't be partaking in this discussion.
 
It's official.

None of this is about mitigation.

This all -- every bit of it -- goes back to the plea deal the State rejected.

She promised that if they didn't bite on her extortion attempt, she would trash the victim and put his family through the wringer.

Promise kept.

Last night, on the Justice for Travis FB/State vs. Arias FB, the following was posted:


Penalty Hearing in a Capital Case -- Procedure

If a jury finds one or more aggravating circumstances, the penalty proceedings shall proceed as follows:

(1) The defense may make an opening statement;

(2) The state may then make an opening statement or may defer such opening statement until the close of the defense's evidence;

(3) The victim's survivors may make a statement relating to the characteristics of the victim and the impact of the crime on the victim's family, but may not offer any opinion regarding the appropriate sentence to be imposed;

(4) The defense shall offer evidence in support of mitigation;

(5) The state may then make an opening statement if it was deferred, and offer any evidence relevant to mitigation;

(6) The defense may offer evidence in rebuttal, unless the court, upon a showing of good cause, allows a case-in-chief to be reopened;

(7) The defendant may present statements of allocution to the jury;

(8) The parties may present argument, the defense having the opening and closing;

(9) The judge shall then charge the jury;

With the permission of court, the parties may agree to any other method of proceeding.

How did they get these texts? These texts aren't during the Jodi time with Travis, are they??

How do they even come into play???? It only proves that Travis was human and not perfect.
 
For the life of me I'll never understand why the judge is allowing this redundancy that has nothing to do with murder mitigation.
 
Okay I've seen the flirty and the horny texts Jennifer. Now show me the abusive ones he sent. After all, you did say he was abusive to women.

I bet the male jurors are thinking this is ridiculous. I am sure they have all had flirty or sexual exchanges online before. It really is not that big of a deal to the millenials. Geff is making himself look like a dinosaur the way he is blowing this all out of proportion, imo.

Yes exactly, a younger jury will view a lot of this testimony as totally irrelevant regarding mitigation.
 
I think in her mind she wasn't "trapping" him. She thought if she could just do a little more, be more like the women he actually wanted, that he would see he was "supposed" to be with her.

Jodi told her father they were getting married?
 
OK , Geffner is gonna stay stuck on the irrelevant sideshow of Travis the flirt. After him yawns a whole lot of nothing if JA doesn't take the stand again.

The DT is either counting on putting on a miraculously coherent close that ties all these very loose strands of a story together, or JA is taking the stand again. As is their mitigation story borders on the incoherent.

If I were on the jury even though that would mean that I didn't know as much as I know about this trial, I would be wondering WHY we are talking about all this? She is guilty and we are supposed to accept that verdict and decide on life or death. If I were on the jury I would not understand why ANYTHING Travis did would mean Jodi gets life instead of death AND I would be spitting mad that the defense team is wasting SO much time on all this nonsense. I know in Jodi's demented head it is not nonsense but in reality, it is.

Yes, the jurors are supposed to accept the guilty verdict. But. It's not this jury's verdict. They didn't sit through the original trial's lengthy testimony, they didn't review the evidence during deliberations, they didn't search their consciences, they didn't reach a verdict. It's not their verdict. Yes, they are supposed to accept it, but I have long believed that the defense strategy is to find the one juror who wonders. Who wonders if that first-degree murder verdict is truly warranted, who wonders if she really did get a fair shake at the original trial. The one who can't quite return a death penalty verdict if they're not 100% convinced of those things. I believe that's why they've been unrelenting in the 🤬🤬🤬🤬/cheating/sexting and the prosecutorial misconduct areas. Mitigation? No, they're looking for that one juror.
 
For me, sex makes a relationship intimate and exclusive. Others may disagree. It depends on the beliefs of the people involved.

On the other hand, stating the relationship had ended and moving 1000 miles away would, for me, end any claim to exclusivity I had on him.

I think I'm arguing with myself.:thinking:

TA says Jodi's and his situation is difficult but she's moving in 2 weeks so that will take care of a few things #jodiarias #3tvarias
 
So Geffner says it's not important who the texts are from, only thing that's important is the content. I don't get that.

Oh Geevee, you know judge Sherry. She allows everything the defense wants in, whether it is mitigation or not.

Defense is "hoping" Travis will look bad enough that the jurors will want to spare Jodi's life. JSS is "helping" them with their hope.

And in the end, if you are a juror, won't you ask yourself why Jodi didn't stay away from Travis?
