Yes, that appears to be where the idea sprouted, not correct?

No. Worst case scenario if JSS unwisely issued final judgment while that motion was pending would be that the appellate court would revest jurisdiction in the trial court to allow JA to be part of the hearing. But IMO Nurmi will be filing a bunch of post-trial motions that will postpone appellate court jurisdiction for months anyway.

Since she's in the courtroom, does this mean she can't be a witness? or do the witnesses get to come in before they testify?

She shouldn't be in the courtroom if she's a witness.
