Plus there was the bit of a mess with what JM told the jury about JA possibly out on parole if given life, though currently by law there is no such thing as parole for capital murder.

Well, as long as the statute and jury instructions read with or without "the possibility of release after 25 years", he should be able to mention the possibility, IMO. It's a fact and what he said last time was that *if* the state made some provision in the future, she could be eligible for consideration. That is true.
