Retrial for Sentencing of Jodi Arias - Day 6 - Part 3

JSS changed her mind so quickly too! She went from kicking the media out - to allowing them to stay - to kicking them out again. It doesn't seem like a well-thought-out decision.

She did it in haste because she did it on purpose. Didn't Nurmi even intimate the rest of the trial would exclude the public and the media, and she didn't dwell on this for a moment? I'm sure she's planning that the ruling will be appealed.

It is a fact that someone posted on a website BEFORE the media were sent packing that: the media would be sent packing, that CMJA had asked for this, and that she would be testifying that day (not allocuting).

It's also a fact that this was posted on a website officially sanctioned by CMJA and Auntie Sue.....sanctioned during what appeared to be an illegal 3 way phone call from jail that her own supporters made sure was broadcast far and wide.

It can be documented that Maria the mitigator posts on that website in a walled off "vent" room for the "inner circle." (Screen grabs).

The person posting about CMJA testifying thought he was posting in that secret little chat room but oops...it was on the main site instead. The post was deleted within minutes, but not before it was captured with a screen grab and widely posted on social media.

Those are the facts. At the time of the post , the media didn't know they were going to be kicked out. Who knows whether or not JM saw it coming.

After the secret testimony ended , who from inside the room could have leaked? The whole list:

-The judge-JSS
-Jurors
-JM
-Alexander family
-court staff
- Nurmi and Wilmott
- Maria DL

IMO there are only 3 logical possibilities, and ALL are on the DT.

Adding...either Troy Hayden is unprofessional enough to report rumors as sourced facts or CMJA took the stand and he received confirmation of that from at least 2 other people who knew she testified and the gist of what she said.

I may be wrong but I thought I read that JA's mom was allowed in chambers and told she would have to leave the courtroom. I also thought I read she left right away. I could be wrong though.

Maybe her mom is "just abusive enough to leak this news" in the hopes of a mistrial?

Maybe the reporters are just giving us a bone to chew on over the weekend by "leaking" that Jodi is the "mystery witness".
Maybe it's Dr. Karp?

BBM: I blame Jury Foreman ...

And if I say any more, I'll be at band camp ... lol !

And I like here too much ... lol !

:moo:

DGC, :seeya:

Not only was he the reason for the hung jury but he also went on national television right after the verdict in defense of JA. None of the other lifers did that. He called Travis 'that guy' and basically blamed him for what Arias did. He is so devoid of compassion and human decency that he was unable keep his *you-know-what* shut for the sake of Travis' family. What a crass individual.

Part of what I'm saying is that the first leak happened even before the event itself and the person being leaked to /doing the leaking was so indiscreet that he or she rushed to tell all to the inner circle BEFORE the event, including that terrible mocking report on the VIS's.

That isn't Nurmi or Wilmott. I'm having a difficult time believing it was MDL, given the sheer ugliness expressed. Who is left as the first leaker?

I've missed a bunch. Saw mentions of the leaks, but this is the first I've seen anything about someone mocking the VIS's. Can you point me to more info about both?

Speaking of mocking VIS's, after the first trial, the spineless, clueless jury foreman went on national TV and said something like, "The VIS's were sad and all, and we all felt terrible for Samantha and Steven, but this trial really isn't about them, so I don't know why the judge let them speak." This from the guy who said jurors aren't lawyers and shouldn't have to make legal decisions. Maybe his brain scrambled during all the juror instructions and during Juan's closing argument. Did everything that might get Jodi the DP make his brain scramble?

Sorry, didn't mean to go off about our friend the foreman. Mainly just want info about leaks and mocking of latest VIS's. Thanks!

eta: Well HBT. (How 'Bout That) Just noticed rose222's post right above mine, also touching on the subject of our favorite foreman. Must be something in the water around here.

As far as the jury and the court room being cleared, I think if I were on a jury and that happened I would think it was because JA was seen as a threat and the room was cleared to protect the public. JMO

OMG, did he really say that? *gasps*

Trying very hard to not get banned now! :silenced:

I thought I read/heard he said he did not want a stay. Yeah, I think it was from the hearing they had with media attorney.
The meeting to decide if media and public were to be kicked out is under seal so we don't know if JM agreed with kicking them out. He did say in the media meeting he didn't want a stay. I can see where he might of fought the motion to clear the courtroom, but later when it was going to delay the trial go against the stay.

I blame the judge for not making the decision when the jury was deadlocked on the sentencing. The burden should not have been passed to another jury when the 200k a year judge could have just given the sentence. Does'nt the jury just reccomend and then its up to the judge. Why are we still dealing with this? I blame the judge and not the original jury.
Because the judge couldn't sentence her to Death, unless the Jury does, that's why. The most she can sentence is Life. I want Jodi to get Death, so does the State , so does the Alexanders, so all of this is worth it!!!

Nana,
the jurors are just folks like us. If I saw that this killer had the whole courtroom at her advantage, provided by the judge, I would think she had maybe been wrongfully accused and I should give credence to what she has to say. For me, this is very prejudicial against the State. I guess JM didn't care. But I can't help but think that JM and JSS did not think this through and it's going to backfire.

Now I realize at the end of the day, Jodi will be going off to Perryville. My only hope is that she is somehow kept in confinement for the rest of her sorry life. I wish I saw something redeemable in her. I don't want to hate her. I wish she had true remorse and had admitted it in the beginning with true remorse and had asked for LWOP. But she has been tying to blackmail the prosecution since she was arrested. And waht really unnerved me was the gall that she had in sending his grandmother flowers and an 18 page letter. Ugh! I could literally beat her myself.

I think JSS and Juan know that this has to play itself out, but no matter what Jodi pulls, the only way she'll be leaving prison is feet first.

Doesn't the fact that the judge has stopped allowing cameras in the courtroom for this second sentencing phase almost give weight to any future appeals that the media attention meant that JA couldn't get a fair trial the first time around? I hope we never end up with a full retrail in this case, mind you I doubt it will happen. I can see us all still following this one in 10 years if she actually gets DP, and then eventually her sentence being downgraded to life. Apart from the Alexanders and the witnesses who have suffered, the other victims in this are the taxpayers in Arizona who have to foot the bill. IMO it's a shame that in the case of a hung jury a judge can't simply made a ruling for LWOP.

BBM. The state prefers Death over LWOP for her, so do the Alexanders, and I'm in full agreement.

I thought everyone was removed from the courtroom, including the Alexanders?

Have to go relook.
No the Arias' were kicked out, but the Alexander's have the right to stay, no matter what. It's guaranteed by the Victim's Bill of Rights.

T-4-2, the VIS mocking was from this

Who knows whether or not that is real.

The leak could have been JA. She knew she'd be on the stand. We know she has, in the past, spoken to reporters on the phone from jail—Troy Hayden for instance.

Night curious, See you Monday. Hey that's just another great thing about living in Arizona, we don't change time. Night everyone, see you Monday.

Yeah, but that means we're now an hour off from you, meaning the trial will begin @8:30 a.m.. and in Dec. it will be dark at 4p.m. Sucks!!!
