Details regarding the officers' involvement came from a recent Extreme Risk Protection Order against the officers. The order would allow a search of the Corrections Officers' persons, homes, and vehicles and would result in the confiscation of their firearms.

That order was declined by a judge.

A hearing was scheduled in the case for January 7.

Court records indicate one officer has already surrendered his department-issued firearm. The body camera footage described is expected to be released by the Attorney General’s Office this week.

According to one person CANY interviewed, “physical abuse is rampant; the CO told me when I got here, ‘This is a hands-on facility, we’re going to put hands on you if we don’t like what you’re doing.’”

A different officer, Nicholas Anzalone, who was named by the department, is also named in a separate federal complaint in 2022, stating he joined an assault on an inmate by another correctional officer at the same facility. The complaint alleges the officer was involved in a cover-up fabricating disciplinary charges against the inmate, who was left with “substantial physical and mental injuries.” The case is still ongoing.

Her client “thought he would die that day, as officers punched and kicked him to a bloody heap. The officers then lied to cover up the beating,” Rosenfeld’s statement says.

Body-worn cameras were deployed to Marcy Correctional Facility in May 2024.

The incident that resulted in his death appears to have occurred immediately as Brooks arrived at Marcy. He was serving 12 years in state prison for stabbing his then-girlfriend in 2017.

Once in the unit, the group of officers put Brooks into a small exam room and crowd into the space. Redacted footage cuts some details out, and with no audio the ongoing conversations between the officers, as well as apparent responses from Brooks, cannot be heard.

This is why my gut reaction was that they tortured the victim. IMO it appeared they questioned the victim and responded with violence based on responses. The victim speaks directly to the camera before the beatings continue. While we do not need to know the audio, I hope one of those many bodycams has provided officials audio.

 
I think the audio would provide further evidence of the torture and the intent to do grave bodily harm of the guards involved. There is a reason they decided not to turn on their body cams thus no audio. The video evidence is strong enough IMO but I do wish we had the audio to accompany it.

I read that she had all of them fired and appointed a new head of the prison so if anyone can enact change it would be the governor.
I don't get why the few politicians had an issue with her visiting the prison.
Sadly this prison gets away with murder with lots of "accidental deaths" reported.
 
Hopefully we are assuming correctly. With the murder on cam I wonder why they have not been charged already.
What would be the hold-up? nothing justifies what happened on video, certainly ramming a sock or fabric down someone's throat isn't proper procedure. Makes me sick that they talk about rewriting policies, it's not the policies that are the problem.

The corrections department, in response to a request by the Times Union last week, had identified the employees implicated in the incident and facing termination as correction officers Matthew Galliher, Nicholas Anzalone, David Kingsley, Nicholas Kieffer, Robert Kessler, Michael Fisher, Christopher Walrath, Michael Along, Shea Schoff and David Walters. Kyle Dashnaw, a nurse, and two sergeants, Michael Mashaw and Trombly, are also facing termination.

That article states: “It might be difficult unless they can tell from the video who is causing what injuries,” said a former prosecutor. “And likewise, it may be just as difficult to, therefore, prove who caused the fatal injuries. …"
I've seen this before, where a stabbing was fully caught on video; five men surrounded another and fatally stabbed the victim, but because they couldn't determine which one of them delivered the fatal stab that severed his aortic valve, they all were charged with manslaughter (Canada) this is just unbelievable.
 
when did the autopsy report come out? would that be the hold up? what other reason could there be? nothing justifies what happened on video. certainly ramming a sock or fabric down someone's throat isn't proper procedure. (The doctor) determined that Brooks had suffered multiple bruises of the face and extremities, fracture of the nasal bone, multiple soft tissue hemorrhage of the muscles of the anterior right and left sides of the neck, hemorrhage overlaying of the thyroid cartilage, hemorrhage of the genital area soft tissues, the penis and both testes. (The doctor) reported concerns for asphyxia due to compression of the neck as cause of death, as well as the death being due to the actions of another. The final cause and manner of death are pending at this time."
