well, this is just my opinion...but weren't there witnesses at the altercation that also said that Ron attacked Hank? Regardless of whether Misty called and requested help or whatever she said, that does not release Ron from the responsibility of of attacking Hank.
I think even the grandma agreed Ron came out, leaned into the truck and started beating Hank. If you are saying that Ron had provocation because of words from Hank, I just say you are wrong. But, then its my opinion only.

And it is my opinion that these people trespassed on the Cummings property, attempted to forcibly remove a person from that property, and Ron did the right thing by doing what he had to defend himself, his loved ones and his property.

You might want to check with the mods on that one. Upstairs we don't usually state opinions as facts. It is an allegation, and he is innocent unless/until proven guilty. We can all have our opinions, but they are not facts, merely opinions.

Witness testimony was entered onto the upstairs threads. I can't help it if what ALL the witnesses say goes against what you want to believe, BunnyP. What we have here is NOT a failure to communicate; we have a failure of wanting to see reality.

Whatever leverage he may have had with the argument that he was protecting his property is lost when he entered into Tommy's van and put the beatdown on him. All witnesses agree; all witnesses gave statements. All witnesses can't be lying.

I don't know who you say is failing to want to see reality. The reality is that it is alleged that he assaulted Tommy. He is innocent unless/until proven guilty. Those are the facts. Where I come from you are allowed to use physical force to defend yourself, others and your property. The Court will decide whether or not he's guilty, if they even proceed with the charges.

When did this "beatdown" happen...link please? I understood Tommy had no injuries...hardly sounds like a "beatdown" to me. Bit of exaggeration on your part I think.

Was the van on the property? Were they in the driveway or on the street?

BEFORE LE found him to ask about the RAT, he and Misty were talking to an attorney? GGMA said to LE he was in St. Augustine...Beardsley's office is in St. Augustine, conincidence?

Money helps...I bet RC grateful for all the donations...Couldn't help but notice Beardsley specialized in family law.....just another coincidence, I suppose.

Bunny, I am quite familiar with what a temporary restraining order is, how to get one, and what happens at the hearing. A TRO or RO often does not ensure anyone protection, so perhaps you are not as aware as you state what the outcome and effectiveness of protective orders are.....many women are dead today with that little piece of paper sitting in their home.

Would it be more effective to press charges against a person for committing or threatening to commit an act of violence rather than to obtain a RSO? RSO seems too liberal an action to grant violent people who repeatedly spin out of control and need to be restrained and removed from the general population to preserve public peace and order. If the abuser is charged with a crime he is likely to be incarcerated and it perserves justice for all until the matter is fairly represented from both sides. Other workable solutions are to escort these women to shelters or relatives.

She said she pushed Hank Jr, Sr and Lisa into their van and told them to leave. She said that Hank Jr continued to yell at Ronald. She said that Ronald came back out and they went to fighting again. She said that Hank Jr was in the van and Ronald reached in again after him to continue the altercation.

I would guess that he contacted a lawyer when he was charged with the burglary and assault...perhaps even called one while he was locked up.

Thank you for that. I've seen it. I'm still not seeing where a "beatdown" took place! Are you saying Ron injured Tommy in some way?

Yes, the police say he "allegedly" did what he was arrested for...and yes, a judge will weigh the merits of the case...but regardless if he thought he was justified for his actions...he was the one arrested...and that's a fact, right?

It doesn't give him the right to assault someone "under the law".


ETA: I don't think any of these folks are angels...but the law is the law. If he had been struck, he should have gone into the house and called the police. Then there would have been a different story to debate. But in that case, he would have been "right".

Lord what a mess!

Lisa C said that she wanted to "check on" her daughter. That's understandable after the phone call. Sounds like Misty's husband came charging out of the house determined that no one was going to see Misty (wonder why? why not just say "Hey, ya'll. It's kind of late and Granny's asleep but if you want to come in you can")

I'm glad that GGM told the truth even though it goes against her grandson.

I never disputed it was a fact that he was arrested. As we all know, just because someone is arrested for something doesn't necessarily mean they did that something.
