A hearing is now starting in the Mallory Beach wrongful death lawsuit. Attorneys are at the Hampton County courthouse this morning discussing two motions

The motions include one to sever the defendants- separating Parker’s from Alex Murdaugh. The other is for a change of venue.

Mark Tinsley is representing Mallory Beach's mother Renee in this case. He is now arguing against the severance. He says there have been no change in circumstance since the first motion to sever.

Tinsley responding to motion of change of venue. He says there's no evidence in front of the courts that supports this "baseless claim." He says there's no question they'll find at least 20 impartial jurors.

Shere claims the goal of connecting Murdaugh and Parker's will only be to get the jury "infuriated" with Alex Murdaugh and then have Parker's pay for it.

Parker's attorneys want a change of venue out of the Fourteenth Judicial Circuit entirely.

Shere now arguing the change of venue motion. He says this motion is different from their previous one denied in 2020 because the first was based on convenience of witnesses and this time they are arguing for a fair trial.

Next up, the request by Defendant Parker for a change of venue from the 14th judicial circuit. Parker has supplied affidavits from local Hampton residents that they say back up the need to transfer venue accd. to the constitution of SC and is required for an impartial trial for the defendant.

Atty for Alex Murdaugh- agreed that the case should stay in Hampton and and as far as severance goes, he’s against it because “Mr Murdaugh is entitled to have his liability reduced by the liability of others”- meaning his codefendant Parker.

#BREAKING: Judge Daniel Hall has denied both of defendant Parker’s motions to sever and the 2nd change of venue request. Moving forward with an August 14 trial in Hampton in the Mallory Beach wrongful death lawsuit.

Right now Judge Hall is conferring with both defendants' lawyers and Beach family lawyer regarding a protective order filed by Alex Murdaugh's lawyer - it's regarding Alex's deposition in Beach case (scheduled for Tuesday 18th from prison). Tinsley opposes this protective order.

Media getting ready for a crucial hearing in the Beach wrongful death case starting in moments. Will the case be moved out of the 14th Circuit? We will see….

Parker's attorney PK Shere just said that "Timmy," Paul Murdaugh's alter ego, drove the boat and killed Mallory Beach, and Alex Murdaugh willfully allowed all of his reckless and illegal behavior, not Parker’s.

Parker's attorney PK Shere: This is a case of a (legal) alcohol transaction versus bad and negligent Murdaugh parenting.

Parker's: This joint case is not about justice for Mallory Beach, it's about money from the deep pocketed Parker’s.

PK Shere just played a recording of Eric Bland on television talking about the "stink" of Alex Murdaugh getting all over Parker's just by sitting two feet away at the defense table. Judge said he will hear no more videos or audios of other attorney opinions today.

Mark Tinsley: If Alec Murdaugh can get a fair murder trial in the 14th Circuit, Parker's can get a fair wrongful death trial in this same circuit.

Parker's attorney PK Shere: In this case, in Hampton County, the Murdaugh name still has influence. Mark Tinsley pointed at the Murdaugh portraits still on the wall here: if anyone is prejudiced against, it's the Beach family.

Mark Tinsley: Everyone in the English speaking world knows about this case. So where would we try it? Where could we move it? Even Alex Murdaugh's attorney agreed with him and opposed the motion to change venue.

Judge Daniel Hall has heard the arguments and is taking a 15 minute break. He may make a decision today.

600 jury notices are going out in Hampton County. Mark Tinsley said all they have to do is find 20 people who can be fair and follow the law on a jury, and that can easily be done.

Judge Daniel Hall has denied both motions, no severance and no change of venue in the Beach wrongful death case. We will go to trial Aug. 14 in my hometown.

Judge Hall is now meeting with lawyers in private conference to discuss a possible deposition of Alex Murdaugh set for Tuesday, but there is some controversy that Mark Tinsley has "moral objection" to.

Alex Murdaugh will be deposed Tuesday at the McCormick state prison where he is being held. Mark Tinsley said Alec is a serial liar who will show no remorse and Tinsley doesn't plan to attend in person.

Finally! I called this a while ago that Parker's Insurer would not allow this to proceed to trial. IMO, Parker is just a bully with $$$$.

As it should be! In my opinion, Mr. Parker, Inc., failed at every turn with this case when he could have settled. Instead, he fought for a separate trial and then summary judgment -- each denied. And this was strike 3. I doubt his insurer will support him going thru with a trial and this attack on the talent was personal and had nothing to do with the merits of the case. He's in good company with Murdaugh as his co-defendant. JMO

The stakes are high for Parker and his chain of convenience stores.

Under South Carolina law, any single defendant in a lawsuit with several defendants is responsible for paying all damages if other defendants cannot pay. Murdaugh, in prison, is not believed to have any assets, now or in the future, so Parker could find himself liable for any jury verdict awarding damages, according to court records.

Arguably, from a financial standpoint, it is crucial to the Beach's case that Parker's be included when the matter goes to trial Aug. 14. Parker's is a multi-million corporation with stores around the Southeast and on track to exceed a billion dollars in sales per year, according to industry reports.

Under the laws of SC, $15M by Parker most likely includes AM's share of punitive damages.

I recall AM had a very minimal boat policy and we know he tapped out his Umbrella Policy with his greedy claim alleging Gloria's accidental, death by his dogs, for quick payout.

It's still amazing to me how all of this was unraveled when Tinsley simply asked AM for his Boat Policy limits.

And I hope Mark uses some of his earned fee for lifetime security. Generations of "friends of Murdaugh" shouldn't be trusted to just accept that the longtime Murdaugh shield, providing favor, has been stripped away from Hamilton County. JMO

According to the victims’ attorney Mark Tinsley, the $18 million settlement was reached Sunday morning after hours of negotiations.

Timeline: New documents, video paint detailed picture of night Mallory Beach died in drunken boat crash

$15 million will go to the family of Mallory Beach, who died after being thrown from a boat driven by the youngest Murdaugh son, Paul, in 2019.

Paul, who was underaged at the time, had been drinking all day, according to the four surviving passengers. The remaining $3 million will be split among the survivors: Anthony Cook, Connor Cook, Morgan Daughty, and Miley Altman.

Alex Murdaugh remained a defendant in the case, alongside Parker’s Convenience Store, where Paul bought the alcohol using his brother Buster’s ID.

The case was set to go to trial on August 14, but will no longer happen.

“We are pleased we were able to get some resolution on this case and keep the Beach family from having to go through the pain and suffering of a trial and hear testimony, and have to relive their daughters’ death,” Tinsley said in a statement. “We are happy the settlement agreement is not confidential as well so that the public sees that you will be held responsible no matter who you are or how much money you have.”

Tinsley added that the agreement does not stop the civil conspiracy case he has filed against Parker’s for the Beach family.

That civil suit alleges that Parker’s teamed with attorneys and documentarian Vicky Ward to launch “a social media campaign to inflict severe emotional distress upon the Plaintiffs to diminish their resolve to prosecute Parker’s for contributing to causing the death of Mallory Beach in the Civil Action and arranged for or participated in the distribution of the confidential mediation and other private materials.”

HAMPTON COUNTY, SC (WSAV) – Attorneys connected to the plaintiffs in a series of lawsuits against Parker’s and Alex Murdaugh have told News 3 a settlement has been reached in the civil case.

This means all the civil cases involving the boat passengers and the family of Mallory Beach will be dropped.

This comes after multiple hours of meetings were held Sunday between lawyers for all parties suing the convenience store chain to talk about a possible settlement.
