Knowing what we know now about how she worked for his family for so many years, I might believe she gave him some of her medication or something like that. We know he's a manipulator. I can see him asking or knowing she took xyz or had access to xyz and asking for some or even in some disgusting round about way suggested he was in pain over something or other and she offered. She sounds like she genuinely loved him, Maggie, the boys and his entire family. I hate that the defense put her on the stand. Believe he was trying to access it like he tried with PM's phone then placed it back on PM. AM running around trying to tidy up after as quickly as possible shoved her phone in a pocket, forget about it till headed down the road, tossed where found. Just a thought of a scatter brained man trying to get out of the area to fulfill his alibi.So why do you think Alex took her phone? Was he trying to get into it? Was it laying on the gator (or go cart) she rode down in that night and he picked it up before he murdered them so she couldn't call for help? Did he forget he had it and then tossed it as he realized it would track all the way to Almeda with him. Strangers/revenge killers wouldn't take her phone so it's odd that he would stage that. It is one thing that is out of place and would have been better if he left it on her/with her/wherever it was. Was it an accident and he realized he had it and just tossed it out?
We know his intent seemed to be to blame someone seeking revenge for the boat accident. Was that always the plan or did he have some other plan in mind?

I don't think the backlight turning on means that someone necessarily touched the phone at that time. There are a lot of things that can trigger the backlight, for example an app notification.
Since both the state and defense apparently agree that MM's phone was at the side of the road by then, I don't think it either exonerates or implicates Alex.

We are all equal under the law, though in too many instances, the law is Not Applied Equally, and Much Less for those who can not Afford Equal Treatment Applied to them.If AM takes that stand, I think it will be a huge mistake. I think it will seal his fate and remove any reasonable doubt. There is just no way he can charm or lie his way out of this. No amount of tears. I have faith that the jury is going to see right through him, given all they've already heard.
Who on the defense team thinks this a good idea? Is AM going to appeal based on his crappy defense? Is that the long range plan with these inept "experts" and the defense witnesses who end up favoring the prosecution?
Also of note, of course I would love to see AM testify. I don't think he interprets "under oath" like us plebs may, though.

Agree, I bet the jury is at home tossing their own phones to see what happens. Mine did not come on.I think on rebuttal we'll hear from the State's cell phone expert again -- saying MM's phone could (easily) be tossed without the backlight coming on. JMO.
My iPhone 13 does the same thing with respect to picking it up - if the top of the phone is higher, the Raise to Wake feature is activated. Next, I tossed my phone about 10 feet across the room several times. I tossed it frisbee style and my phone did not light up when it landed flat on the couch. I tossed it end over end and, surprisingly to me, when it landed flat, it did not light up. On either toss, if it landed at an angle with the top of the phone up against the back of the couch or if it bounced causing the top part of the phone to be momentarily higher than the bottom, the phone lit up. My husband looked over at me and asked, WHY do you keep throwing your phone around the living room? I explained the situation and he commented, well, if I was going to throw it out a window, I wouldn’t hold it by the edges, I’d pick it up and hold it like I would a ball but my finger would touch the screen and wake it up. Huh…he’s right.Interesting. I have Raise to Wake turned on my iPhone 14 Pro, and I just did some tests:
In other words, for the Raise to Wake feature to function when the phone is lying flat, the top of the phone must be higher than the bottom. If it's picked up in any other manner, the phone does not wake up.
- If the phone is lying flat and I pick it up from the top so that the phone is at a 45 degree or greater angle, the phone wakes up.
- If I pick up the phone but keep it parallel to the ground, the phone does not wake up.
- If I pick up the phone from the bottom, it does not wake up, even when the phone is at a greater than 45 degree angle.
- If I pick up the phone so that one side is higher than the other, the phone does not wake up.
I even tried throwing it and the phone didn't wake. (Not a significant distance, just a short toss onto my couch.)
