DEFENDANT’S PRE-HEARING BRIEF
RE: MOTION FOR A NEW TRIAL

On October 27, 2023, Mr. Murdaugh filed a motion for a new trial based on after-
discovered evidence, having obtained leave from the Court of Appeals to suspend his appeal of his
convictions to file the motion. His motion alleges that Rebecca Hill, the elected Clerk of Court
for Colleton County, had extensive private communications with members of the jury during trial.
This allegation was supported by sworn affidavits of jurors and a witness to juror interviews,
testimony at in camera proceedings, and other evidence including Ms. Hill’s own book. The
subject matter of Ms. Hill’s alleged communications was the evidence being presented at trial. Mr.
Murdaugh alleges that an elected state official deliberately violated his constitutional right to a fair
trial before an impartial jury. If that allegation is proven, the law requires a new trial.



With that important caveat, at present, Mr. Murdaugh plans to call the following witnesses
in his case-in-chief during the evidentiary hearing:
• Juror 254
• Juror 630
• Juror 741
• Juror 785
• Rhonda McElveen, Barnwell County Clerk of Court
The State must call Ms. Hill to deny the allegations that she tampered with the jury. Depending on
Ms. Hill’s testimony, Mr. Murdaugh might call some of the following witnesses as rebuttal
witnesses:
• Laura Hayes, former deputy Clerk of Court in Colleton County
• Jeffrey Hill, former IT Director for the Colleton County Courthouse
• The Honorable Clifton Newman, retired Circuit Court Judge
• Tim Stone, ex-husband of Juror 785
• Timothy Stone, original poster of the FB message presented to Judge Newman
during trial and included in the Court’s Exhibit 4
• Lori Weiss, employee of the Clerk of Court in Colleton County

And this crap show just keeps on rolling like a locomotive off the rails. I just literally have to shake my head and roll my eyes at this hot mess. I don't know who to be more upset with: Alex, Harpo and Griffin, BH, her son, those jurors.

There are plenty to pick from here, although without AM, none of this would have happened, so I'll stick with him. :mad:

Co-author of Becky Hill’s plagiarized book says he will donate some profits to charity​

I don’t know about you but I see that as more of a publicity stunt or trying to save face in the literary world or something than I do actual remorse for participating in the publishing of a book containing plagiarism without doing his own due diligence. I remember reading the preface and wondering who wrote it because it wasn’t as poorly written as the rest of the book. (I actually wondered if he wrote it.) If he knew BH sent in that preface, he should have recognized that too and inquired about it before it went to print. He said they were donating proceeds (after expenses) from the sales that took place after they tried to cancel sales through Amazon but apparently Amazon insisted on continuing to sell the inventory it had/has on hand. If he really wanted to distance himself from BH and the plagiarism then he would be donating all proceeds they received from the sales since the beginning - not just since the news broke that plagiarism was involved. I am not impressed and while I am not defending BH in any way in any of this, I don’t think he needed to throw her even further under the bus either. I saw him on CourtTV and he wasn’t just addressing his shock and sorrow regarding the plagiarism. When asked if that changed his opinion of whether she was guilty of the things she is now accused of he should have just said he didn’t know - which is what he should have said all along instead of defending her when the accusations of jury tampering first came out. I am not impressed with him and wasn’t when he was defending her either. He wanted a piece of the action and inserted himself into BH’s world to get it and now he wants to wash his hands of it - but keep the money from all the sales up to the point he contacted Amazon to stop future sales. Time will tell I guess but in my opinion he still has a lot of dirt on those hands he’s trying to wash.

Was #741 the remaining alternate? And wasn’t that the one that put the blanket over her head one day and tissues in her ears the next?

I’m pretty sure that I recall that one of the Holli Miller affidavits was regarding a statement by #741 and of course #785 was the dismissed juror (egg lady) and they had an affidavit from her.

I think #630 was the one who said in her affidavit that she felt pressured by the other jurors to vote guilty.

But I don’t recall the defense mentioning #254 having made a statement to them. Does anyone have any info about that?

I believe that #630 & #254 were both part of the 12 who deliberated, is that right?

I keep hearing the "catch all" phrase - "donate some to charity."

It's to cover a person's rear....means zero.

Part of the South Carolina estate where Alex Murdaugh killed his wife and son is garnering bids of more than $1 million ahead of an auction next month.

J.P. King and Crosby Landy Company announced Monday it'd be selling the Moselle Estate in an online auction Feb. 15 with a listing that makes no mention of the crimes that took place there years ago.

Alex Murdaugh’s lawyers said Friday they may call lead Murdaugh prosecutor Creighton Waters and Aubrey Hill, the daughter of Colleton County clerk of court Becky Hill, as potential witnesses during an upcoming hearing on allegations that Becky Hill tampered with the jury during Murdaugh’s double-murder trial last year.

Murdaugh’s attorneys made their plans known in a brief filed Friday.

The brief is a supplement to one defense attorneys filed earlier in the week.

The State Attorney General’s office declined to make a statement, saying, “As is our policy, we will make our comments in court and court filings.”

Friday’s supplement also says defense attorneys might want to call Carly Jewell, a paralegal with the Attorney General’s Office who worked with the team who prosecuted Murdaugh, David Owen, the South Carolina Law Enforcement Division agent who led the investigation into the murders of Paul and Maggie Murdaugh, and Rachel Joseph, another SLED agent.

SLED had no comment.

It seems so strange not seeing my main Judge Crush - Judge Newman up there. :( I do wonder what he's feeling about BH and all the craziness that has happened? I'm sure he's devastated as he seemed to put a lot of faith in BH.

No matter, AM isn't going anywhere I feel certain (he already has to serve 30 years on the financial schemes). On the off chance he were to be granted a retrial on the BH/juror tampering, he'd be found guilty again IMO.

After hearing Maggie's sisters testimony at trial I doubt she's contributing a penny to his Defense. Agree, maybe some of the other swindling siblings are pitching in.

BM only got $500k out of the Moselle settlement, I don't see him financing Pop's defense, but who knows?
