i was just thinking how interesting it is that we know which way the jury is split in regards to guilty/not guilty, you never hear that - you only hear the numbers, split 11-1, 9-3 etc

First time for everything, I guess. This is a new one on me.

IANAL, but it seems to be a huge appeal issue if this jury does convict after the letter sent to the judge by the holdout.

they have not returned to deliberations quite yet, not to be a stickler...

they have gone back to put together a note to clarify what further instructions on the law they believe will help them reach a verdict. there is still a chance that when that note is read, or when the judge relays what instructions he will give them, that the defense can object etc, or the holdout juror could try to get another note through that claims those further instructions definitely will not change his mind...

i believe the judge is making the right ruling here, because even the foreperson said that they were hopelessly deadlocked, but then backtracked on that when informed that the law allows for them to receive additional instructions on the law at this point if they believe it may help. now if the holdout juror were to send out a note immediately after the judges new instructions saying that he is certain that this new information will not change his mind - then i think the judge would have no basis for not declaring a mistrial, and it would be a legitimate appeal issue (tho i agree with you that the defense is already planning an appeal on what the judge has ruled so far regarding this issue, they have to).

The judge in the trial of the North Charleston police officer charged in the death of a motorist is waiting for word from the jury about which laws they need explained further.
This development came after the jury told the judge late Friday afternoon a "further explanation of the law" may help them reach a unanimous verdict.

ETA. I think this article has it right, but having watched it live I wasn't sure if they left to deliberate or write a note.

Wow, what a roller coaster that was.

If recent history is any indication, then imo 1 in 12 people are emotionally unfit for jury duty when it comes to a uniform.

Maybe it's time to change the setup for taking a uniform to trial - since many feel that the uniform has special privileges, level the playing field somehow.

The current practice and this trial will only incite people into taking their frustrations out when/where they shouldn't. Jmo.

Watching the news and another officer fired in North Charleston for using excessive force...N. Charleston is #7 most violent in nation. They aren't going to be able to get officer's to work that god-forsaken place. Bomb it!
