What is 'slack space?'

It's the space on a computer hard drive that contains deleted files. When you delete a file it isn't really gone, it's just in the slack space (or at least a part of it still is). That's why forensic computer experts can recover data that has been deleted.

Here's what I would like to know. With all these devices having cp on them, why did no one else in the home notice these? Especially a computer.

What about internet history? No one noticed?

Because the only CP that has been found, so far, has been on the computers and it was found in the slack space.
Whoever was viewing it, probably when they were there alone, thought they got rid of it.

After seeing the affidavit statement that a picture appeared to be child , I was wondering about who has the burden of proof as far as the age of the person in the pornographic picture. This is a very good link from the perspective of a defense attorney:

At trial the prosecution has to prove that the individuals in the pictures are minors. Sometimes that's obvious just from the pictures, but if if it's not it's up to the prosecution to track down the actual individual in the picture. You can imagine how hard that would be for some random internet picture.

It also talks about the burden of proof as far as who is responsible for the child , and how that is fertile ground for defense attorneys since the prosecution may have to prove a negative (that nobody else who used the computer, other than the accused, put it there).

The last paragraph talks about how the defense attorney can claim that it was downloaded accidentally. Obviously this probably depends on the amount of child found so it may or may not be something LE will have to take into account with Shawn since the child was found in the slack space. It would be important to know whether he deleted it after Hailey went missing or not (and when he downloaded it too).

I hope they caught him red-handed but it does seem like there are a lot of grey areas. His luck has to run out sooner or later.

It sounds to me like a lot of child was found and we know what I have suspected all along that the memory stick belonged to Shawn!! I don't think Billie did anything to her daughter however I think maybe there is some knowledge of what happened and that she's covering for Shawn. Poor Hailey. I bet Clint is just beside himself for finding this stuff out.

What I find interesting in the affadavit is that 3 adults, Shawn's grandmother, her adult son and her adult daughter all live in the house in Dunn and not one of them was home at approx 6:30 am on Monday Dec 27th according to SA. :waitasec:

It sounds to me like a lot of child was found and we know what I have suspected all along that the memory stick belonged to Shawn!! I don't think Billie did anything to her daughter however I think maybe there is some knowledge of what happened and that she's covering for Shawn. Poor Hailey. I bet Clint is just beside himself for finding this stuff out.

To be honest IF Shawn did anything to Hailey and Billie knows and is sticking by him instead of going to the police..then really shes no better than Shawn at all. Hailey is her daughter..and Billie should be putting HER first and NOT the "awesome" boyfriend. Billie telling the investigators where Hailey is is the last decent thing you can ever do for your daughter..so why not do it? Forget about Shawn. Think of Hailey!

I do understand about the slack space but what if those images were deleted when Hailey went missing and were on the computer undeleted until that time? We don't know if he deleted them as he downloaded onto a memory stick or not.
