I wonder if he is the kind of expert who says whatever he is paid to say. Seems to me if Arias want him as her witness during her mitigation phase she would have some assurance that he will say what she needs said. IDK, not actually knowing the person or his possible motives.

You pay them for their expert witness that will be in their favor No point in putting on an expert that's not in your corner.

Well, the difference from an appeal is, for starters, there is no "hearing" on an appeal. :) No witnesses, no presentation of evidence at all, just a review of the evidence from the trial court (transcripts).

And the other difference is that this new jury will be told she has already been found guilty and the murder has been found cruel and they must accept those findings as true. They are only being brought "up to speed" to the extent that the details have anything to do with mitigating factors and balancing those against the one aggravator (cruelty). They can't say, well, I don't even think she's guilty--but they can say, well, assuming she's guilty and he suffered (cr:loveyou:uelty), I just don't think he suffered ENOUGH to justify putting her to death in light of all these other factors.

Right. But some people will not lie and those are the ones who tend to be sought always by the same side in any trial. And then we have those who will say anything you are willing to pay them to say.

I am wondering which kind of expert Aiken is.

Spellbound and others, if y'all pray, and I hope you do, please remember me. I went to the doctor for MRI results thinking I have a kink in my back since the spasms started a couple weeks ago. It turns out I have an obstruction in my left kidney and pelvis and have to see a urologist. Don't know what is up, as the back doctor said that is not his expertise. It was a hard day and I am in pain so I think I will rest and read all your posts. Thanks for keeping me company. :).

Oh and Spellbound, I returned the Acer tablet. Didn't like it but I just got a new one, a Samsung Galaxy 4, 8 inch. It is wonderful and very light. I am using the iPad now since I am sitting but going to lie down and use the tablet. Oh and I don't know if they will do the cataract surgeries now until they know what's in my kidney. I know what you mean about dry eyes. I have had them all my life, just not as bad as yours. Must use drops all the time. Bless your heart, eyelid surgery sounds painful but I am glad it helped.

Could you have kidney stones? Hope that's all it is because they could just "blast" them.

I will pray that it's that simple.

I can't wrap my mind around the sentencing phase retrial bringing the jurors up to speed. What is the difference in this and an appeal hearing? I mean, what if a sentencing retrial juror doesn't think the 'up to speed' evidence is enough to find the defendant guilty? How is the evidence resubmitted to only direct the 'guilty' verdict?

I don't know exactly how to explain my confusion, but the whole concept is so foreign to me. The jurors come in knowing the defendant is guilty.

I'm not a lawyer, but it sounds simple to me:

"This 'person', ( who is smirking, arrogant, narcissistic, combative, not remorseful, and thinking she is an Einstein lawyer- and don't forget- a liar in the highest degree :( ), is guilty of 1st degree, premeditated murder that was cruel and heinous - already decided on by the previous jury. There will be no questions about that. Can you abide by that? Yes- good- you're on this jury. No- goodbye. :facepalm:

You are here to come up with the sentence of death or life. Weigh all the evidence that is presented - aggravation vs mitigation- and make up your mind. Are the mitigating circumstances that are stated by the defense, enough to let her live or does the aggravating circumstances outway the mitigating, enough to sentence her to death? You chose (and hurry up about it. This trial is dragging and I'm losing my patience here). :mad:

An appeal is scrutinized by judges (no juries) who come up with a conclusion that the appeal (that the appellant, who was previously called the defendant, is whining about) is valid or not (the verdict/sentence was already decided by the jury/judge) and a retrial has a jury who will determine either life or death, in this case.

Simple.

I've been busy, but always lurk!

Am watching Autumn also. Around 4 AM she sits on the floor resting and licking her privates. LOL She's done it the last 2 nights so it shouldn't be long now. Did you know giraffes sleep standing and only sleep for 10 minutes or so at a time?

From what I heard on the Hulsey trial today, he is a whiner for the murderer and cries about how well (or not) the murderer will fare in prison. That prison will be punishment enough, so please don't sentence this poor pitiful murderer to death. PFttt.

The trial is still going on. They have anotherrrrrrrrrr defense expert to whine for Hulsey (who tortured cats and cut his mother's finger off to get the ring). Pfttt.

Wednesday ?.... Is your pain acute, as in, Severe, Sharp, Stabbing? Or is it more of the chronic type... Mild, Aching ... ? Did they mention anything about the possibility of kidney stones ? Do you have any history of kidney infections or other problems ? Just thinking, if it's severe pain, you might consider going to the ER. Hope you're doing ok, Prayers.

D-E-N-I-E-D! I like the sound of that now Nurmi can just sit there and observe Mr. Martinez and learn a thing or two. Maybe he can bring his lead counsel a strawberry frap, actually I don't care what he does I'm just happy that JSS denied the motion and didn't sit on it.

As far as the delay request from the convicted murderer maybe she can use the seven to twelve hours she uses to trace her drawings to focus on her witnesses. Maybe she needs to restructure her day better, she did say it was up to her to structure her day. Nope, no to the delay if she has time to draw she has time to do what is necessary to be ready for Sept. 8.

I not real sure what she has to prepare anyways as she probably just wants to have the last word with Chris and Skye Hughes. Chances are what she has to question them about has nothing to do with being able to save her life, but more of just telling them off. We all know the convicted murderer just has to have the last word.

If Mr. Martinez calls Dr. Hayes that will be priceless the fog versus the Master.

What possible reason could CMJA have for wanting the Hughes to testify?

JMHO, I think she just wants the last word with them, I think she just wants to tell them off ... sort of like if it wasn't for you Travis and I would have been together and married. Yea right and I have Diamond Head for sell.

Thanks for posting this! I must say this whole thing is causing something to happen which I would have thought was impossible: I'm actually feeling a little sorry for Nurmi. I'm sure it's just temporary and I'll recover in an hour or two. But, jeez, what a mess.

Your post made me laugh have you recovered? Did you need the whole two hours?

I actually feel a little sorry for Nurmi too. I can tell how much he despises his client. And he is stuck like glue to her. LOL :panic:

I told you all about my back. It's getting better and I am to see the doctor today for results of the MRI but I believe I am healed. Hey, the great news is that I am having cataract surgery next week! Maybe I can finally see again to drive and not wear these glasses. I have cataracts on both eyes and it causes my vision to be really fuzzy. So please keep me in your prayers. Maybe by September 8th I will be good as new...I mean, for an old lady. Ha. Getting old isn't a lot of fun. And the anger I felt towards JA and the AZ court yesterday wasn't good for me. But hey, since JSS ruled that Nurmi isn't going anywhere I feel better. Now if she will just rule that we can see the trial I may grow to love her. :).

Dont you just wish you could have seen the look in Jodi's eyes when she heard Nurmi is staying as lead counsel? Will she represent herself? She did make the threat ya know. Oh I hope she does! Nurmi can sit back and laugh and squeal, at least to himself. After hours, he and JW would have a lot to laugh about. Wonder if Jodi will come up with a new plan. Let's see, she has tried fake pedo letters, a phone sex conversation, firing Nurmi, representing herself once before, migraines, temper tantrums....have I forgotten anything? I am thinking she may be having a dose of reality this morning.

Curious, congrats on your upcoming cataract surgery! One caution... don't be surprised if your color choices in décor seem a bit off. After my first surgery, I looked at my beautiful, dusty rose, walls and realized they were Pepto Pink! Long-time, extremely near-sighted, I now drive without glasses and only used store-bought ones for reading and the computer. I also discovered I had eyebrows!

ETA: Just read about your back issues. Let's hope you get that all cleared up soonest so you can have your cataract surgery.

As for JA, she's probably as angry as she can get that JSS didn't take her threat seriously. If she is stubborn enough, she just might go and try to represent herself, but I doubt it. She's just about run herself out of time by being sneaky with the Sheriff's office... trying to sneak visits with friends instead of submitting her witness list.

She has already been found guilty of aggravating factors, i.e., cruelty. I don't think it can be debated anymore, can it? Mitigating factors only. Like...she's young, she's oh so intelligent, an artist, a super-duper vocalist (she may even be allowed to break out into a chorus of "oh holy night" during her closing argument), has nice hair, loves animals, got hit with a wooden spoon, and so on.

Am I missing anything?
