Just thinking out loud, also have some questions/concerns:
My understanding is Arias cannot claim in this retrial that the first jury got it wrong. Correct?
Correct.
She cannot challenge the guilty verdict with statements of her "innocence." Correct?
Correct.
But if she brings anything not allowed up in her allocution, what can happen? Anything?
​Juan hit her over the head......no, she's given the guidelines for what is allowed and her attorneys WILL go over it before she presents it. IF she goes out of bounds, someone will cut her off, Judge, Prosecutor, Defense, or maybe we'll see a little stun gun action from the sheriffs.
I believe TA's family can make statements again this time...will their statements happen after her allocution? If so, can they turn around anything she states that was proven wrong at trial?...Such as, "I am innocent and acted in self defense and I stand by that even though the first jury didn't believe me."
"Impact Statements" are BEFORE her allocution. They can NOT say "We want her hung by her toes", etc. etc. They can only say how this murder and the loss of Travis has effected their lives. (http://www.azbar.org/media/58847/3-capital_case_instructions_revised_2013.pdf starts on page 30, Penalty phase) I think there WILL be some re-writes from what we heard in the first penalty phase. If CMJA has an evening or two to "ponder" over their statements before she allocutes, expect her to stick the knife in by twisting their words to fit her agenda, like she did last time around.
