That's one option available to judges, but it doesn't address all the potential issues. Every case has to be considered separately.

That's what concerned me, all of us I'd guess, about the joint trial. The room for potential issues would be huge, imo.

I imagined a trial awash with recesses (sp) for consultations, many sidebars and confused Jurors. Thank you!
 
Sievers attorney said they are not ready for an October 1 trial due to severance motion granted to Rodgers which allows him to have a separate trial from Sievers.
Sievers lawyer claims that motion granted changes their strategy.

Rodgers attorney is hoping to be ready by Oct. 1 but can’t say for sure right now.

The motion hearing is set for Sept. 9 at 8:30 a.m.

I can't say I'm too surprised by the outcome, I'm just glad he didn't get an innocent verdict. This is FL after all. Knowing what we know vs what the jury knows is hard to swallow but a fact. I think the jury did an awesome job.

Since the jury said they didn’t think Rodgers had a weapon, I don’t think they thought he was in on any plan or committed the murder, just that he either knew it occurred or was there and didn’t stop it. To me, the result of this trial seems to make CWW’s testimony inaccurate, so I’m not sure what the state is going to do in the MS trial. They surely can’t say JRR bludgeoned Teresa when a jury found him not guilty of that..

right?? How does this work now?

There's a difference between not thinking he had a weapon and there not being sufficient evidence presented to prove that he did have a weapon. Something similar recently happened in the Dan Markel murder trial. One of the jurors who hung the jury said in an interview that she believes Katie Magbanua (a conspirator) is guilty, but she didn't think the state proved it.

The third defendant in the case, Curtis Wayne Wright Jr., already pleaded guilty to second-degree murder as part of a deal with the prosecution. He was a big part of the prosecution's case during the Rodgers trial and is expected to testify again during the Mark Sievers trial.

    Rodgers could be sentenced to life in prison for the second-degree murder charge. He is set to sentenced in front of Lee Circuit Judge Bruce Kyle at 1:30 p.m. Nov. 18. Family members of Rodgers and Teresa Sievers are expected to give impact statements at the hearing.

I am going to be honest re verdict; Yes I am disappointed with the 2nd degree murder guilty plea but they did their civic duty and voted on what they thought should happen with what was presented to them. Personally, I wanted to see JRR suffer more with the DP because T did not deserve this brutal death. After the ME's testimony, I was in rage with the brutality of it all. Hoping JRR gets Life with no parole.

Accomplice Felony Second Degree Murder occurs when you are an accomplice to a person who kills another human being while engaged in the commission, or attempted commission, of the following statutorily enumerated felonies, regardless of whether they intended the death:
  • Burglary (in this case)
Penalties for Second Degree Murder
The crime of Second Degree Murder is a First Degree Felony in Florida and punishable by up to life in prison, life on probation, and a $10,000 fine.

Second Degree Murder is assigned a Level 10 offense severity ranking under Florida’s Criminal Punishment Code. Absent grounds for a downward departure sentence, a judge is required to sentence a person convicted of Second Degree Murder to a minimum sentence of 16¾ years in prison, but may also sentence the person up to the statutory maximum of life in prison.

So he was found guilty of second degree murder. Let's hope he gets life.

Both of those convicted in this heinous crime have been convicted of second degree murder.

I'm ok with that and REALLY hope the mastermind behind this, Mark Sievers, gets convicted of first degree murder. Is Mark's trial a death penalty trial?
