Tongo: Even if our communication was via text message or telephonically, there was some communication. That's important.

VZ: Why didn't you tell the court that during evidence-in-chief?

Tongo: As I've said, there are a lot of things that we discussed. For me to say I said this in one call and that in another call.

Tongo again recounts the hijacking

VZ: Mr. Dewani remembers it slightly differently. He recalls someone next to him on the back seat telling him to lie down. That would be Mngeni. Are you saying that he is wrong?

Tongo: At the back, it was me on the left, Dewani in the middle, on the left side was the lady, Qwabe was driving. Xolile was also in front.

VZ: So Mr. Dewani is wrong that the person next to him was the person with the gun.

Tongo: Those are lies.

Van Zyl reads Tongo's statement in which he said he was pushed to the passenger seat.

Tongo: Sir, I can see that's written but what I'm telling you now, is what happened and that's why I said. Some of the things are resurfacing. I admit that I signed this statement, but what I am saying here is what happened.

Traverso: Was that part of the agreement?

Tongo: I can't remember us discussing the child locks but I did it.

Traverso: Did you tell Mr. Dewani about it?

Tongo: I don't remember telling him


(Judge getting quite involved again but this is still dragging on, no end in sight)

Tongo: Behind the police barracks, is a stop. Xolile opened the door from the outside. Xolile opened his door, stretched his arm and opened my door.

VZ: Who closed it?

Tongo: I don't know

VZ: The handles to open the doors are clearly visible (photos). Are you saying that Mngeni opened the front door, leaned over and opened the rear door, without getting out of the car?

Tongo: Yes.

VZ: We'll have to test that.

Tongo: I'll be very happy.

Tongo: Qwabe never pointed gun at me, they both instructing me to get out, that's what I did.

VZ: You said driver put firearm against my head. You saying he never pointed firearm at you?

Tongo: That's what I just said.

I wonder if Xolile made any statement for this trial before he died. It's now just Tongo's word against Qwable re number of guns pretty much anything else. Qwabe on the stand implicated Xolile as the person with the only gun, and the one who shot Anni.

In his statement, Tongo says the driver put a gun to his head, now, he says it was a mistake. "Qwabe never pointed me with a firearm." It was my mistake.

Tongo: that's one of the things I forgot and remembered as time went on.

VZ: this thing about Mngeni opening the door for you, why wasn't that in your statement?

Tongo: yes its not in statement.

Tongo:didn't know I would end up being in trouble for mentioning things I remember.

Judge: you're not in trouble.

Tongo says in court that he gave police his correct car registration number. In his statement, he says he gave the wrong number.


(what on earth is going on here? He's practically rewriting his statement, and Dewani is smiling, just seems so surreal to me.)
