Mopp: They were not trying to convince the court. They both made concessions that the accused was emotional

#DewaniTrial The accused offers an excuse for their return trip to Gugulethu. He takes the suspicion off Tongo. He says "my wife wanted to see the township" The reason for their return was much more sinister.

#DewaniTrial Mopp: The court is lead to believe that it is completely fortuitous that two ppl are waiting & lo and behold, the deceased wanted to go back into the township at that exact time?

Mopp: The accused's explanation has not been tested. There is no reference. This is an important bit that cannot be ignored

A young man, growing up in the township, on the straight and narrow, not involved in crime, will be able to tell you exactly where dagga (marijuana) is sold, where drugs can be bought, where alcohol can be bought, who the armed robbers are. My Lady, it is not so improbable.

Imo, SD is going to be found not guilty if the trial continues. Even in Australia, only 50% of contract killings come to trial and a guilty verdict reached, and most of those secured because the person approached by the instigator, goes to police and an undercover cop tapes/records evidence against instigator or instigator left incriminating evidence in the killing or the killers are found and give evidence against the instigator.

What was always in SD's favour, it happened in South Africa, not the UK, and the police didn't have enough evidence at the time to hold SD in SA to ask him pertinent questions. They could have wired up Tongo to gain SD's confession if it were true.


This is the file by the Australian govt. on statistics etc. on contract killings I mentioned a few threads back, just if anyone is interested. :) What I found interesting in the case studies, the sentences for the killers were lighter than even what Tongo and Qwabe received.

What I hoped, and I'm pretty sure the Hindocha's wanted also, is SD taking the stand and answering questions put before him. That will never happen now a dismissal is likely. SD should have no fear of being a witness especially if he's innocent.
