The first time I was in a courtroom, I was probably around 20 yrs. old, and would guess were someone to describe my demeanor, it would have been 'she looked like a deer caught in headlights'. JMO

Yeah, there's a lotta heat about his phone, the fact that his mom had it and the fact that it had been deleted. Methinks it's uber-important!

Just to sidetrack a minute:

Why is this not a death penalty case? Premeditation?

Perhaps because Canada doesn't have the DP, & due to our relations with Canada, and the possiblity it might not be premeditated, etc.

Anyone who is going to watch the video later, make sure you watch this argument while the jury is out of the courtroom. It will be towards the end because it's 5 o'clock now.

Everytime the defense get's this riled, you just know it's something of importance.

"You've attacked every piece of evidence in this case, I'm going to allow it" to the defense.

Ohhhhhh Fireworks regarding Brad's phone now...I didnt realize it too had been erased....Yikes this does not look good on the def. in the judges eyes...
I think this witness is going to be able to testify he saw that phone being in Def custody..I think Mr. Tenkle..sorrry about spelling.....LOL These two def. attny's are like a tagteam....

Mr. T (def) really does get his BP up doesnt he!! Now he's laiming 5th ammendment rights etc......I wonder if claiming mishandling of evidence by def. not such a good idea..

To be clear, defense said that they were looking at the data report from FBI and there was some data on the phone. So, it wasn't completely wiped. The CPD didn't seize the phone until October, so it's not like it would be weird to see the defendant with it.

Well, to be fair..that is their job..HOWEVER, they went prior to this trial abunch further and claim mishandling of evidence, poor investigations, corruption of evidence.....Hummm..Not a good move on their front IMO

Hmm, wonder if Brad (if convicted) will get to serve time in Canada.

Also, find it hard to believe that "being Canadian" would play a huge part in those determinations. Canada does not have the DP but we have certainly extradited persons to the US that are facing those charges in the past.

So Brad's attorney wouldn't want that phone in his possession, handed it off like a hot potato to Brad's mother, because if he had it in his possession he'd have to share it with the prosecution maybe? JMT's??

I **really** like ADA Zellinger. He knows how to throw a strong argument and he stands his ground.

Witness saw Mr. Kurtz hand phone to Brad's mom. Phone was found, according to that little exchange, next to Mom's purse on the counter.

Witness sent an email to Det. Dismukes about handoff of phone.

Would this be the same phone that said it only had something like 30 minutes of usage?? The one that was talked about yesterday, was it?

I'm sure this has been discussed, but who actually believes that someone in his profession doesn't know how to pull up their call history? I mean, my 75-year-old mother - maybe - but not a CCIE.
