Kara, 5, had been stabbed repeatedly. Erin, 3, had been bludgeoned to death. Kathryn "Katie" Eastburn had been tied up, apparently raped, and stabbed fifteen times. Those injuries were more than enough to kill the woman and the two girls; in a shocking example of what police call "overkill", the attacker had also slit each of their throats.

This case always reminded me of the Dyleski case.

I think it's safe to say that whoever killed Michelle had gloves on. Because IIRC there was no dna or skin under Michelle's nails. Surely she would have tried to scratch her killer as she was being strangled. I think it's safe to say if a killer was wearing long sleeves and gloves it would have been very possible for them to leave that very one sided fight without a mark on him.

what about marks on the face or neck.... You can bet ur sweet bootay if someone is trying to kill me & I have the chance that jack wagon will be carrying some type of wounds if possible...

It was state law (by the NC Supreme Court) up until the case cited in the boring legal stuff I posted that a second degree murder instruction had to be given, if the state was proving premeditation in a 1st degree case. Then that got overruled to say they are not required to give that instruction unless there is a basis for such.

So did you guys hear that the state is asking for that in this case? An interesting turn if so.

No I missed that part so I dont know if the State wanted it in but you would think they ask for it to be included.

I just heard the defense objecting to it and was overruled.

If Jason killed Michelle, he would have to have some kind of a mark somewhere, imo.

I mean come on, they even photographed him without his clothes on.

Michelle was attacked while sleeping. There wasn't, IIRC, signs of a struggle. She never had a chance to fight back. So why would Jason have to have some kind of marks on him? Especially if he's wearing long sleeves and gloved up?

I agree if JY did commit this crime (I think he did) then he did it with much planning beforehand. And compared to many other murders it appears Jason didn't do too bad a job of planning. He certainly didn't commit this murder Casey Anthony style. Which in my mind although I really dislike that Casey Anthony got away with murder I'd be far more scared and concerned if JY got away with murder as well. I think he's far more calculated and dangerous than Casey Anthony. At least Casey used chloroform on her victim first. Poor Michelle was fully awake and endured what must have been an excruciating beating.

I dont have a link n/t. I was watching WRAL and at the end of the day heard the Judge say it would be either first or second degree but he did say they would discuss it further in the morning.

That's a bit naive. Why would he have a mark if he overwhelmed her with a bat or some other object? She had no chance to even get up.

He hit her 10 times, correct? I do fully understand what you are saying and do agree that it can mean that the killer was someone known to the victim.

However overkills by strangers are done more often than some may think.

I could list many such cases of overkill by a stranger but one of the top of my head is the Sarah Walker case out of Texas. She was hit 22 times and stabbed also and the perp turned out to be an ex-felon who did not know Ms. Wallker. He was just a ruthless killer who probably had rage to begin with and just mean as h*ll.

Grit, I didn't hear it, but apparently it was overheard during one of the feeds coming from the courtroom. Acting in concert with another (that would still be 1st degree, yes?).

To me, that would be even more evidence of planning. Here's the in concert instruction:

"For a person to be guilty of a crime, it is not necessary that he personally do all of the acts necessary to constitute the crime. If two or more persons join in a common purpose(fn2) to commit (name crime), each of them, if actually or constructively present,(fn3) is guilty of that crime if the other person commits the crime and also guilty of any other crime committed by the other in pursuance of the common purpose to commit (name crime), or as a natural or probable consequence thereof.(fn4)

FINAL Mandate

If you find from the evidence beyond a reasonable doubt that on or about the alleged date, the defendant acting either by himself(fn5) or acting together with (other persons) . . . (continue with appropriate mandate).

His family compiles a list of items stolen (6 months after the murder) but doesn't claim any stolen items on the homeowner insurance policy. Does that make sense?

Why not report what is stolen right away? Why wait 6 months? Why not report it to the insurance company?

Especially if giving police this information early on in the investigation also gives the police the opportunity to find said stolen items in say a pawn shop....and therefore they might be able to locate the random robber/brutal killer they want us to believe exists.

Also it is strange that CY said mommy got a spanking for biting when JY had no bite marks.

I ended up spending the day in the ER. I was in pain, which is what sent me there, yet all I could think about was this trial and worrying about what I was missing. I just got home about an hour ago and instead of heading to WRAL to watch today's video I came here instead. Glad I did as it appears I didn't miss much.....except the inside scoop on CB. I knew immediately I didn't like her yesterday. Sometimes my 6th sense works.
CT scan showed I have an infection of the stomach and small intestine....very painful. Have no idea how or why. More medical stuff to follow but it's going to have to be done around the rest of this trial.

Maybe when he was choking her... I would be fighting which she did.. That's how her neck was scratched... She was trying to remove someone hands... I don't know about anyone else, but if someone were choking me I would be slapping or scratching the persons face, neck whatever I could...

Other sites are talking about it too because others heard the same thing and are as shocked as we are.

Maybe the Judge is allowing the defense to find case law to refute the second degree charge.

That's right ... some injuries were caused with hands, others with a weapon. The Sheriff said that he expected that the murderer would have injuries.

Depending on her position she may not have been ABLE to reach her face. Or she may have been severely compromised by the blows she had already received. Marks in a struggle are never a guarantee. Especially in a struggle that occurs when one person is attacked while sleeping.

Yes, she scratched herself trying to pry the hand of the killer off her neck.

Do you really think he would tell Cassidy what he was really doing and why?? Obviously, he wasn't killing her because she bit him.
