Hi Everyone,

I'm new to the board, but not to this case. I followed the events on the old CTV message Boards soon after MY was found. I've read this board through many trials over the years and decided it was time to join.

I wonder how long the jury instructions will take?

Bear with me while I try to adjust to the site/features!

If necessary, I'd drop from G on 1 to G on 2 to reach a verdict vs a hung jury.
If you were on the jury you would go with G on 2 to get out of there?
I wouldn't, if I felt they didn't prove it.
Or, are you coming from the PT side?

I have a question... JY was a very popular man, best all around in his school, many, many friends at work, at NC State, at home in Brevard, etc, I did not hear from any of these people vouching for his character as a loving father/husband/friend.

Why did the DT not have any of these people testify? There has to be one person that likes JY other than his mother/family. Who?

Character witnesses are used in the sentencing phase if the defendant is convicted.

Not sure if you watched the Brad Cooper trial, but the one thing that struck me about this one was that I didn't notice any of the prosecution witnesses saying bad things about JY(a complete 180 from Cooper imo) - everyone had good things to say about him and didn't seem to immediately think he killed MY.

Several people did testify that he was great with CY and that he and MY had a seemingly normal relationship. Even when people testified about some of the asinine things he did, they didn't seem to dislike him, it was like "yeah, that's Jason."

I would never compromise if I felt the evidence did not show second degree and in this case the evidence doesn't support it.

I think the worst thing the Judge did was to put in second degree. It goes against everything the PT has entered and their theory of the case.

And I think it was a mistake for the PT to admit that someone else could have been there when the PT has said all along that Jayson alone did this crime. It muddies up their theory.

I hope it doesnt leave the jury confused.

Regarding overkill, I've mentioned my theory a few times that I think the intruder could have been planning to rape MY - and I fully admit there is nothing to back this up evidence-wise.

However, after the closing arguments today and seeing the pictures of MY's closet disheveled and rummaged through, the unidentified prints on the printer papers, etc, I can't help but wonder what the person was looking for, if anything.

Does anyone who is on the fence about JY have any thoughts about that?

Ultimately I think the reason for overkill is that the killer planned to overtake MY quickly and did not expect her to put up a fight. I would think that whether it was JY or someone else.

Also - I don't necessarily think JY is innocent. Nothing about the case makes sense to me whether JY did it or not, but his guilt has not been proven for me beyond a reasonable doubt.

This case reminds me so much of another case and for the life of me can't remember her name right now. Is oceanblueyes still here? She would know. :banghead: The beautiful woman who was murdered and her baby left alive. She was found by her step son who called 911.

That case was also very horrific and brutal. I don't think it's ever been solved. Some felt the husband (he was a gambler) killed her. Some suspected the step son. Some felt it was someone who wanted revenge against the husband. Money was stolen from the safe.

In that case, the baby girl was also left alive covered in her mother's blood. :(

So all that to say, that it is very possible that a stranger is capable of overkill. Then there was the Pamela Vitale case that was brought up before.

So, how did the 2nd degree come about? Who brought it into play in the first place? I only saw that the judge said it applies.

Would this come from him, or which team would have asked for it?

It was not from the DT. They were protesting the second degree category. I am assuming it was PT and/or JS.

The charge of 2nd degree is something the judge added on his own. I mean he would likely put on the record any objections to that (I think the DT did object), but it was at his discretion to see if it was a charge that the jury could consider.

I remember in the BC case the judge added it and neither side had asked for it.

I'm 100% convinced that JY is guilty. If I was 75% sure he was, that's enough too. I don't have an reasonable doubt at all. There are just too many strange coincidences that happened that night/early morning, just happened to be the same night his wife was murdered??? Common sense that these aren't really innocent coincidences....

75% is not enough for me. Although, I am 100% here. jmo:seeya:

I don't understand that because if JY didn't mind tracking blood around the master bedroom, why would he mind(anymore than a random killer would) tracking blood throughout the house?

Carpets can be replaced, walls can be painted, etc. If he planned to murder his wife I doubt he was too worried about doing a bit of interior upkeep to clean up after. Not to mention his own bedroom was completely messed up. Why would he worry about the rest of the house?

Doesn't make sense.

I don't feel he thought that was a possibilty when planning. I think he minded a great deal. jmo
He minded so much, he didn't ever talk to LE until the trial.

Whatever happens, I am proud of Becky Holt and Howard Cummings.

IMO, I think they may have just sealed JY's fate. He is nothing but guilty.

I am safe.... My ex who abused me is long gone from my life...

Shocking that you can't believe JY would be capable of his violence escalating having had this horrific experience.

I did not watch the Brad Cooper trial, I have just recently learned about it through this trial. I got the impression that I did not hear from any of his friends and/or those that testified or anyone to state that JY was a loving husband and a good friend, thus, not capable of murdering his wife, which leads me to believe his friends thought JY murdered his wife. I guess perception has a wide spectrum. Thx for the response.

I am 100% guilty on this case. The camera activity at HI, his behavior during the marriage and after MY's murder, the gas purchase, lack of forced entry, insurance policy increase, missing clothes and shoes...I could go on and on. DT never overcame any of it IMO.

JY is guilty of being a lousy husband, a cheating husband, and displaying very inappropriate behavior. He very possibly may be guilty of this murder or involved in it, However, the PT still has not proved beyond a reasonable doubt that JY is guilty. As Wolfpack has indicated, we are left with too many assumptions of certain coincidences to conclude he is Guilty.

Nothing at the hotel leads me to be convinced he actually left the premise that night. I threw out Gracie's testimony so I have no eyewitness putting him out of the Hotel. There are unknown fingerprints at the crime scene, and jewelry taken at the crime scene. The size 10 shoe print has not been conclusively resolved as to source. The HP sole prints could have been made by a similar shoe or by his shoes if the shoes were in the closet and not at Goodwill. There is no evidence that medicine was given to CY. I threw out CB's evidence as well, but FH's testimony seems solid. CY failed to mention her dad's name when re-enacting the murder with the dolls. JY had no identifiable injuries to his body. It appears someone cleaned CY and there were no fiber transfers or blood between hotel and the home.

All of these are MOO.

Isn't it strange that so many times a husband wants out of a marriage and their spouse end up murdered?
I feel that there were too many coincidences in this instance. Just too many coincidences imo.:seeya:

If the jurors don't reach a verdict tomorrow, do they deliberate on Sat as well?
