I wondered that myself. Last time I heard her was a couple days ago, she did a live call-in from Calif.

She was at the other trial of that LaCrosse player. She should be there today since it is over. jmo

With all due respect children that young DO NOT articulate spanking for hitting. CY was in day care. If children strike one another they are told "don't hit!". Parents refer to a spanking as something they do to a child. If the child does it to someone else (including the parent!) the parent would say "don't hit!". The fact that CY said mommy was being spanked points to no one but mommy or daddy. And we know Michelle didn't do that to herself so...

I mean in her head she knows if she bites, she gets a spanking; therefore, maybe she thought her mom did the same thing. I doubt JY would talk to her because she knows his voice. I do think he is guilty Im just saying what I think. A child that young would state her father was there, it wouldnt take much. CY didn't know her daddy was there, cause daddy was wearing a mask.

I disagree. At that age children do understand the difference between hitting and spanking IMO. My grandson's know about 'getting a spanking'. Spankings come from mommy or daddy. Yet when they 'run to tell' on each other, they never say 'Zack *spanked* me.' They always say 'Zack HIT me.' They understand the difference between the refrences of HITTING & SPANKING. Parent's spank, the kids 'hit' each other.

Was it ever mentioned how often CY was 'spanked'? I would think if it was a rare occurance (lets face it, a lot of parents these days don't spank their kids), she may be confused about it.

I see your point, I just have a different theory. I don't think he intended CY to wake up so he put the CD on in her room to block the noise. That either didn't work or had the opposite effect and woke her up. When cleaning her up, he explained that daddy had to spank mommy. Why? for biting. He might have even said not to tell anyone, maybe said daddy would get in trouble. Another possibility is that children are very sensitive to situations that we may not realize they understand and she might be subconsciously protecting daddy.

Side note: I don't know every exact detail on how things happened but I think there's enough evidence to show his quilt without having every single detail and I'm hoping the jurors agree.
