JTF, do you know if MF caught that at the time it was said. I am guessing she was in shock and probably did not catch it.

I would never have caught it without prompting, honestly. So I'm not sure many of them did, if they were focused on listening to Meredith. So, the prosecution has to find a way to play it again, have an enhanced version of just CY, or find a way to get it out there that they need to listen for it. It's not something you can put in the transcript if there's a debate on it, so it will be interesting to see how that works out.

Very few have heard "daddy did it", unless directed to the exact spot on the recording and asked to listen carefully to that part. Sure, the jury will have an opportunity to listen to every syllable in the jury room if they so desire.
When I said "not admitted", I was referring to the state making specific reference to the utterance as evidence.

Were Cass an adult, or teenager, it would certainly be considered an excited utterance, completely admissible.

Okay, thanks for the clarification.

My assumption too, cody.
The poor woman was still on 911 and could still not fully comprehend what happened to her sister.

I imagine she was in shock. I was impressed she held it together as much as she did.

  • #307
I heard it right away, but that may be because my little girl and C. are only a couple of months difference in age and honestly and I was paying more attention to what she was saying while the phone was ringing. I just assumed it was in the transcript the jury was given. Incorrect?

I was too, Cody. I'm sure she was just trying *not* to freak out in front of C. When she said (paraphrased) "I'm usually better than this under pressure" a couple of times, it made me feel even worse for her. She did great.

NC mountain crafts are very popular.
This particular item has been a best seller so far this summer---so i'm told.

I really tried to give JY the benefit of the doubt at first but as he didn't even ask what happened to Michelle plus not allowing the Fishers to see C. My doubt vanished when the search warrants were released. As he kept doing stupid stuff like putting his pic with C out there to draw chicks it sickened me. I don't have one teeny shread of doubt. I am glad no DP for him. He should suffer. He will.

I just listened to the CCBI guy's testimony - darn glad I could not see the images. His description alone was much worse than my imagination allowed me to think way back when this case came to light. I'm not sure an injection for JY would be adequate...it angers me to no end to think if he is convicted he will spend his life playing basketball in the exercise lot.

One other comment - I also listened to the Detective who took the stand after Gracie Dahms - if one listens you will hear that LE never asked her about a vehicle description. According to this detective - Gracie provided the description of the vehicle to LE at the first interview. I find her quite believable, her providing the vehicle description with zero prompting from LE is enough for me to believe her 100%. He was there, he was on his way back from murdering his wife and unborn son.

Hey RC!:) I never thought about that! ugh. Hopefully it will be like SP where he only gets out for 5 hrs a day and spends the rest of his day in a cell with a slot for his meals.

Hopefully, he will be convicted so that his daughter will have a better life.

Good point about Gracie!

I meant to comment on this earlier. I have two friends who work in prisons in NC. If it makes you feel any better, I can pretty much assure you Jason will NEVER be allowed to play basketball in prison. The courts are controlled by the inmates and they would never allow Jason to play on their courts. IMHO.

I think you are right, Lib's mom. At least, I hope it is very unpleasant for him.

Is it true inmates have a code...meaning killers of women & children are targeted?

I've heard this universally, but then heard that it's not true, though I suppose it depends on the prison.

For instance, people said Scott Peterson would be a target at San Quentin for killing his wife and unborn baby, but he hasn't. In fact, he fits in quite well, and according to the warden he's with a compatible set of inmates.

Jason looks like a typical North Carolina hillbilly ... I doubt his looks are unique in that area.

That is hilarious :floorlaugh: , I shot hillbilly juice out my nose when I read it.

Which area?

The last I heard about SP was that he's doing well with inmates because as far as they're concerned he only killed his wife and so no big deal. They do not recognize an unborn child.

ETA - Link

Predictions that Peterson might be ostracized – or worse – because of Conner's death have proven not to be true. "In Scott's case," says Robinson, "the perception [among the inmates] is that he killed his wife, and yeah she was pregnant, but he killed his wife. He hasn't encountered the challenges others face who have killed kids individually."

Thanks lib's mom! Can you elaborate a bit more please? What is the basis for them never allowing him to play. I don't know how good jason is at the sport but seems to me he might be considered unless murdering your wife and unborn child is the reason

I would LOVE to think this would happen!

Probably because he is white. Race is a big issue in prison.

Actually, from what I've heard, murderers are at the top of the prison "food chain." That doesn't apply to child murders. Sexual predators and child molesters are at the bottom. So, it just depends on whether they view the unborn son as a "child." He will be well known though once he gets there. Everyone will recognize him.
