I'm sorry. I'm not bashing the witness, but I can't imagine testifying at a murder trial and smiling. Just seems a little inappropriate. I know she's trying to portray J all sweet and happy, but....................:(

eta, sorry have to leave. court will probably be out by the time I get back.

Our eldest daughter lost her significant other about five years ago. It was a sudden, tragic stroke, much like Clarence Clemmons. They had been together over 15 years, we all loved him dearly. And to this day we tear up upon seeing his picture, or when we reminisce about him. We might tell funny stories/memories of him, but we still shed a few tears through our smiles/laughter. And he wasn't brutally murdered. Some of us here on WS 'tear up' over these deaths. :( MOO

Pat and Gerald decided that even though Linda asked Pat to have Jason call her right away, they would talk to Jason after he arrived. They did not tell Linda that they were going to wait until Jason arrived to tell him about the murder. It sounds like they never did pass along the message ... not sure.

When I'm nervous or in an uncomfortable situation, I smile and sometimes even laugh or make a joke. It's just how I deal with being uncomfortable...my brothers do the same thing. So if I were even in court (never have been...knock on wood) I would very likely be smiling a lot too.

Jason arrived at about 3 when Pat was on the phone with her friend Bev Goins. As he stepped around the front of the car - talked about the dog coming around the car - then Gerald blurted out that Michelle was dead. Jason went pale and went down to the ground. Jason said "that can't be right", he started crying and asking a lot about C. They got him inside the door on the bench ... they thought he was going into shock. They put him on a recliner and they got a blanket and tissues for him. They tried to get him to eat and drink, but then about 3:15, he made a phone call to Meredith and she was telling him that it was a homicide. Bev and her daughter and another friend Jimmy came to the house. Jason was sobbing. He told Bev that he not only lost his wife, but he lost his son.

Pat knew that they couldn't drive to Raleigh under those circumstances, so it was decided that Joe would drive. They lived 20 minutes away. Heather and Joe arrived an hour later, so they decided Joe would drive Jason's vehicle. They decided to all drive together in Jason's vehicle: Joe driving, Heather, Pat, Jason in one vehicle, and she brought some peanut butter crackers and juice, and a blanket. Gerald stayed ... they have lots of animals, dogs, cats ... so Gerald stayed at the house.

They got a phone call from Bev during the drive (about 5 o'clock). Later Kimberley called, detectives or sheriff's dept. She talked to one detective, who told her that Jason "better be" with her. She had been so sad that she hadn't thought about someone saying something like that. She talked to Meredith and some of Jason's friends. Near the Applebys, Ryan phoned and said (was together with Josh and Chad) ... Ryan said to ... Pat, and Pat said to Jason: yes, that they felt that Jason needed to get a lawyer. They stopped their trip to Meredith's house because Ryan suggested that they not go on to the house until Jason had a lawyer. Heather had a lawyer so she asked him to recommend a lawyer.

I think the view on this forum is hugely different from mine--but I could never take someone exercising their right to counsel again them. I think it's an intelligent thing to do, but looks bad in many peoples' eyes.

They went on to Meredith's house and went inside. Heather, Joe, Jason, Pat went inside and spoke with Meredith and Linda. Colleen was there, as well as Meredith's boyfriend.

Jason asked Meredith about C so Jason went to the bedroom where C was asleep on the bed. Some of Jason's friends were at the house too: Ryan and Shelly. Police arrived before Ryan arrived.

Lawyering up before seeing your daughter. No way, I would not stop before I saw my daughter, particularly if I were innocent.

It sounds like it was the right decision for Jason to get a lawyer right away, especially since Ryan and other friends told Jason that he needed to get one before meeting with police.

IMO, it's the haste that troubles most of us. I personally don't believe PY's statment that the police said to her on the phone 'well he better be' when asked if Jason was returning with them. I just don't buy it. It doesn't at all sound like something LE would ever do.

I think so, but apparently Jason went into shock so his mother tried to feed him, have him drink and then covered him with a blanket.

I agree. I know most people would not, but I would never be questioned by police without an attorney. I've never had any experience with being questioned, never been a witness or questioned about a crime involving anyone, and I know I'd be nervous and uncomfortable. Therefore, I would exercise that right.

I'm reminded of the many, MANY *innocent* people who didn't 'lawyer up' before speaking to the police. Mark Klass, Mark Lunsford, Steve Groene, and so forth. If you know you are innocent, it isn't usually one's *first* thought upon learning a horrendous crime had been committed against your loved one in my experience. MOO.

I don't blame him for lawyering up, but I would have wanted to see my daughter first. Just IMO. So, it is the timing of lawyering up that surprises me. Clearly, they were more concerned with his lawyering up before anything else. Just my opinion.

I'm shocked they aren't standing as the jury enters. Isn't that the usual procedure?

It's not done in Wake County -- I think it should be, but they haven't asked for my opinion on that yet (!).

I don't know what other NC counties do. I think standing reminds everyone, especially the jurors, how important they are, and it shows deference & respect.

But anyway, we don't.

Always aggravating and teasing the girls (sisters) ... made them really angry.

I think this is about the time his social development stopped. (I say this in all seriousness). His social maturity is stunted and he's been able to get away with it in a lot of situations, but his employment history shows this lack (as he gets older, this silliness really hurts him professionally, and I don't think he realizes it) and his actions in his relationships with MY, LF, and so many others etc., show it as well. JMO.
