I'm still debating on telling him the hearings on frye issues are not the 23rd -25th of February.

I am prepared to go either through the roof or through the floor as AZ assured me on the Lawyers' thread that it will be like a mini-trial with "objecting" and all, I bet my boots JB will surely object to everything, as is his nature.

I know we laugh and jeer and shake our heads at his ridiculous posturing, and nonsense motions, but according to AZ, nothing he has or hasn't done has even come close to incompetent lawyering.

Apparently as long and the defendant is happy with her lawyer, there is no rule that lawyer needs to be a good one.

And if the Bar has issues with this latest complaint, it will most likely take at least as long as the trial will last or longer to finish the investigation and make a decision about whether to proceed or not.

Weird, eh? Who knew this would be acceptable lawyering. And I think Baez will stick to this one as hard as he can because he needs to complete it to become death penalty-trial certified.

Isn't it ironic that he seems to know exactly what he can get away with, get by with, but seems to have no grasp on anything else?
 
Yes, he explained and explained that he has no problem with the PROCESS the expert used to find chloroform, just with the...um...methodology...or something. Did anyone else understand WTH he was talking about? :waitasec:

Thanks, Logicalgirl! So, if there were even a chance that he were deemed incompetent, the judge would do so before the trial begins? We wouldn't go thru an entire trial process and then have someone (Casey, her parents, etc.) claim that he was incompetent? I appreciate your patience with me and my naivety - I'm really honestly trying to learn this process. Thanks again! :)

Now hold on just one minute. JB is obviously incompetent. BUT nothing he has or has not done has come close to anything that would lead to a reversal on the grounds of ineffective assistance of counsel. There is a huge gap between incompetence and ineffective assistance of counsel. Believe it or not. :) The confusion you are feeling is because we in the field of law refuse to use the English language in a normal manner.

Is JB actually admitting, in a legal document no less, that he can't focus on defending his client? What does this suggest re incompetency? Is he trying to set something up here that is appealable or is he just witlessly thwarting himself?
 
I just have to echo everything you've all said. I just about fell out of my chair reading this "motion" (Hey, Jose - you urgently need a proofreader!!) and I'm still shaking my head. It's (not its) apparent he's waiting until the last minute to write these motions (when he's not already late)...that's the only explanation I can come up with for all of the grammatical, spelling and even sentence structure errors. I find myself wanting to take a red marker to the darn things and sending him the corrections, FGS!!

I agree with whomever said upthread they believe MM wrote this with JB leaning over her shoulder throwing in the snarky parts. (Sorry I don't recall who it was - I've been reading for nearly 2 hours, LOL.) And LL's "vacuum" analogy was spot on, lolol.

Oh, darn, I have had a scratchy throat all day and getting all stuffed up tonight, so I think I'll be too sick to go in to job #1. *sniff, sniff & cough, cough* Guess I'll just have to stay home and watch TV all day. SIGH...poor me! :D

PS - Hugs to the ones who've dealt/are dealing with dementia issues in their families. I know what you went through/are going through...

Well, I could have been a REAL party pooper and broke it to JB that JA does not have the below, a jury does.

He *might* manage to get this DP under his belt, but, doesn't he have to have tired 5 to get the whole enchilda and *badge*??

For some reason, I'm thinking that to be completely DP certified, you have to have more than one going for you ~

And, personally, IF he manages to make it though this one, I don't think he'll even be able to sell tickets for ticket master, let alone defend a parking ticket.

BBM: I'm sure I read that somewhere, too - probably here ages ago. ITA that he won't have another client hire him for a DP case again if he's still practicing law after this debacle. I suppose he could go back to making a living defending DUI type clients...but I wouldn't hire him for ANYTHING myself. He'd probably screw up a closing. :rolleyes:

Yeah, well, I've been practicing law for 17 years and couldn't understand JB's motion either, so I'll join Mr. Ashton's club.
