I am more ignorant that I thought of the way trials work, I had no idea that defense had to give over discovery as well. what took the SA so long to ask for it?
Then again I think they know that defense has totally ... nothing.
This whole debacle has already put his name out there IMO. This is where the problem is in my mind. Isn't it the attys ultimate duty to protect his client? He and his dream team surely should realize that the plea bargain is the only way to go at this point, and I truly believe the state would be receptive and would welcome that. I may be wrong, but taking the DP off the table would be a wise move by the prosecution to stop the insanity. No pun intended.
I would like to know if Calif. (that's where Macaluso is from, right?) has that same kind of reciprocal discovery law. I do think that hiring attorneys from out of state could be like a mine field if they have not become familiar with the Florida laws before they speak in court. And that's what I think happened here.

Yes, they do. And this is not something that isn't common in all courts throughout this country. If you engage in discovery it's reciprocal.

The problem with this is that KC would have to agree to take a plea. A plea that would certainly require her allocution to the "facts" of what happened, and KC will NEVER say she did anything wrong! Instead, she'll get the needle.

goldfish,you are not ignorant at all,I also felt the same. I was under the impression that the burden of proof was on the State,and defense really need do anything except contradict anything the State may come up with during trial.

I know! It's as someone posted the other day - there are so many other cases that have come and gone in much less time with much less evidence...why is this case seemingly so different? I'm waiting for the defense to refuse to provide discovery because it might convict Casey lol. I don't understand it at all. I love Judge Strickland, but what's with the delays and the bending over backwards for teaching schedules and unprofessionalism?
IMO, the only thing I see them handing over on discovery is expert witness depos (plant, insect, air decomp analysis), etc. to refute what the states experts have reported.
