Simpson's attorneys and the state are going to meet for a discovery hearing on Wednesday.

The last court hearing happened in February. Both sides have been waiting on evidence from the Texas Rangers.

Today's hearing for Brad Simpson, which is at 9 a.m., was reset to allow his public defender some time to brace for an evidence hearing. Simpson and his attorney Steven Gilmore were supposed to be in court last week to go over the evidence prosecutors have compiled.

What exactly will be presented in public by either side of the murder case remains a mystery, but prosecutors say they’ve collected terabytes of data against the husband and father of four.

Prosecutors telling the court this morning they’ve handed over the bulk of digital evidence in the case and are halfway through about a thousand pages of paper documents.

Simpson, through his attorney, previously filed a motion to quash the indictment alleging that the indictment was so vague he wasn’t adequately aware of the allegations against him.

"I think I do have enough evidence to proceed with the motion to quash now, so I would just ask for a hearing on that within 30 days," Gilmore told Judge Perez when asked if there were any issues to iron out concerning evidence.

Now the two sides will reconvene on April 22, when when Perez will address Gilmore's request to toss out the indictment. There, Perez will either start open arguments or schedule a bench hearing.

What a pair!

I believe the State thought Cotter was dumber than he appeared (prior to counsel) when he allegedly allowed them to view his phone etc., and they did not contest his reduction in bond and freedom to travel.

Nonetheless, it makes sense Cotter's defense does not want to fight his own case before a jury where their defendant was friendly and helpful to a wife killer! JMO

It has been six months since Suzanne Simpson, the Olmos Park mother of four, vanished. ...

However, six months later, Suzanne’s remains have not been located. Right now, investigators, prosecutors, attorneys and the family are tight lipped because of a gag order.

... we do know Brad’s defense team is working to get his indictment thrown out.

Brad’s next hearing in April 22 at 9 a.m. for the motion to quash the indictment. A trial date has not been set.

Meanwhile, according to online court records, a trial date for James Cotter has been set for May 21st.

Brad Simpson is due back in court Tuesday afternoon, this time for a child custody hearing.

He was already ordered to have no contact with his youngest child and could only send letters to his teenage son. His older two children were able to decide if they wanted to stay in touch with him.

Right now, Child Protective Services has to review any letter sent by Simpson before it gets to his son.

A custody hearing was held on Wednesday regarding the children of Brad Simpson.

Brad Simpson, who is charged with murder in connection with his wife’s presumed death, was not present at the hearing.

  • The children's guardians appeared virtually and confirmed the children are doing well.
  • Brad's family is hoping to gain conservatorship over them, and Brad is aware of that.
  • He spoke with CPS last month.
  • CPS confirmed that LE is still actively looking for Suzanne's body.
  • The next hearing in children's court is in July.
 
I hope his public defender is just blowing smoke. I don’t think Texas requires a body. I also don't think Texas requires a manner or cause of death. I think the courts accept circumstantial evidence to prove a person murdered the missing person. Does anyone know for sure?

I think that Texas does, why else is the judge reviewing the evidence? In Montana, a man was convicted on much less evidence, on murder. No body. It was an interesting case, because they used the fact he had turned off his cellphone during one day, after his GF disappeared.

Prosecutors, however, say this is an evidence issue and stand by their indictment claims.

They say this is a matter than be dealt with as evidence is presented at trial. Gilmore says it points to a larger issue, noting prosecutors are still waiting on at least six reports from the Texas Rangers investigation into the alleged killing furthering his inability to build an adequate defense.

Ultimately, 437th state District Judge Joel Perez will weight the arguments and decide if the indictment stands. He's expected to hand down his decision after 9 a.m. Tuesday, April 29.

A father of four has been behind bars for nearly six months because his wife vanished after a series of public disputes between the two. Now, a judge will decide if investigators have amassed enough evidence to proceed with a murder trial against Brad Simpson.

He continues to plead his innocence, but a judge on Tuesday, April 22, will decide whether or not a jury will have the final say on whether he’s a killer or not. Suzanne Simpson’s body was never found, as far as any public release from police or investigators suggests, but prosecutors say state and local officials compiled terabytes of data, including video evidence, against the local husband and father.

Simpson’s public defender, Steven Gilmore, filed a motion to quash Simpson’s murder indictment less than 10 days after the charges were filed. Simpson was charged with murder on November 7 – 15 days after he was booked into the Bexar County Jail – and Gilmore filed his motion to review the evidence against his client before a judge by November 14.

During the hearing, Simpson’s defense team withdrew parts of their motion and narrowed their challenge to only a specific portion of the indictment — Paragraph B — which they claim is too vague.

“If you are going to allege an act clear and dangerous to human life, they need to know what that act is,” said defense attorney Steven Gilmore, referring to the language in the indictment.

Gilmore argued that the state cannot prove the act alleged in that section without knowing the specifics. Prosecutors pushed back. They said the absence of a body does not prevent them from pursuing the case.

The state was given more time to respond. Both parties will return to court on April 29, when a final decision is expected.

Gilmore argued that Brad has the right to be informed of the nature and cause of the accusations against him through US and state constitutions.

Casey Sandoval, the lead prosecutor in the case, disagreed, arguing that the state doesn't need to prove how Brad killed his wife, only that he intended to do so and ultimately caused her death, Express-News reported.

Additionally, Sandoval stated that a medical examiner's determination of Suzanne's cause of death is not required to move forward with prosecuting her husband for the crime.

'The law doesn't reward people who are disposing of the bodies of their victims,' Sandoval said, according to Express-News.


'The case law is clear that the state does not need to prove how Simpson murdered Suzanne Simpson.'

The judge's decision is due on April 29.

In an April 22 hearing, Gilmore's arguments focused on the provision of the indictment alleging Brad had the "intent to cause serious bodily injury" to Suzanne and "did commit an act clearly dangerous to human life that caused the death of Suzanne Simpson, by a manner and means unknown to the grand jury." But, Gilmore argued, the penal code doesn't have the burden of defining the parameters "act clearly dangerous to human life."

"I don't get to prepare to defend against whatever act the state may be alleging," Gilmore said, arguing he's working from a legal disadvantage.

The state responded by saying they didn't have to prove how Brad may have killed Suzanne, rather only that he intended to do so and did.

Makes me so angry.

He successfully hides her body, then claims he can't present a decent defense because the State won't say how he did it.
