No, I don't think so. It applies to attorneys, their staff, and LE involved in the case as well as witnesses who have given statements to LE, the DA as well as those who have or will testify in court proceedings. MOO

Will it actually go to trial that day? Probably not. But, nevertheless, an update in the case.

Cotter’s attorney filed this motion Tuesday morning asking a judge to remove GPS monitoring and his restriction on traveling more than 75 miles.

Absent from this latest request to the court is why but attorneys we have talked to say that’s to be expected. They say details will likely come out if and when the judge sets this for a hearing.

NEW: An attorney for James Cotter, the longtime business partner of Brad Simpson, is requesting Cotter’s GPS monitor and 75-mile travel restriction be lifted. Absent from the motion is anything about why Cotter is making this request of the judge 1/

But defense attorneys tell me that’s normal for the motion to be bare bones. We should learn more when and if it’s set for a hearing. Two have said that GPS monitoring isn’t a typical condition of bond for a charge like this, but the 75 mile requirement is standard.

One would envision authorities would be watching the accused like a hawk! If that release is to be granted. (And I am not advocating that it should.)

He is already accused of criminal activity relating to evidence in this case. And there is still a missing wife of a friend, IIUC presumed deceased.

And with the propensity to attempt to remove, hide, or otherwise affect evidence who knows what else the suspect might do if given half a chance? IANAL. MOO

just read the transcript on the link. its very detailed and "summarizing the facts" is not a smart way to absorb what its about. the story has new pieces added based on the evidence and facts. so listen like radio on headphones.

Judge Joel Perez is now presiding over both cases for Cotter and Simpson and he has granted Cotter’s request to travel.

...the order states he is allowed to travel out of San Antonio from Jan. 25 to 28.

According to court records, Cotter traveled by himself to Edmond, Oklahoma. He stayed with his “in-law,” records show.

At this time, the reason for Cotter’s travel request remains unclear.

In a no-body homicide, I don't think it no surprise the prosecution is not objecting, and the Court is granting, what seems like special privileges such as travel to visit the in-laws to James Cotter.

We know BS family not behind him so good chance he turned to Cotter. Those 'deals with the devil' are the most difficult pills to swallow but we have to trust that the state must really needs what Cotter has to offer. JMO

As part of Cotter's bond release conditions, he was on a GPS monitor and had a 75 mile travel restriction which was recently waived when he was granted permission to travel to OK. There was a Motion filed end of December to lift these conditions-- I wonder if this is what will be heard on Feb 7?
