Judge Caproni said the three men were expected to be brought to Manhattan next week, and that they would make their first court appearances before her on Jan. 29.

 
Am I the only one thinking that the time has come to legalize and regulate what is now called SW business? We have these scandals on one side, and on the other, there are horrible victims of LISK. So much of it stems from illegality of the whole area. I never thought I’d type this, but since it is a business that is not going to disappear, and yet there are no contracts regulating it, plus, so much is bartered, probably contributing into the drug epidemic, the public has to read about the details to understand what “no consent” means.

With these guys, I can already see why and where it is not what’s called consent. Girls 17 or such, buying them alcohol, taking them to a hotel afterwards, the accused men are up to their necks in it. Filming someone without their consent, gang raping…too much of all.

And the whole court will be the prosecution and the lawyers fighting over, essentially, where consent starts or ends.

I think there will be more cases to come. The whole business is predatorial. I just think that once upon a time, we have to acknowledge that the area exists. In its current form, it all verges on being criminal. It is unregulated, might involve minors and probably contributes into spread of drugs. Not to add that all is untaxed.

Also, thinking of the victims from the humane side. They are, probably, young. How many years and therapy will it take for them to deal with the consequences.

How did they graduate from colleges? It is obvious that the business was their parents’ creation. But did they hire people to write their essays?

Not nearly as horrifying as what their victims went through. Cowards. They will not be received well in prison.

Arielle K. has filed for divorce after less than two years of marriage
and not long after the birth of their first child.

'I will continue to provide my young baby with love and support as I leave my husband',
Arielle said via her attorney.

'This commitment to my child's best interests and well-being
will remain my highest priority'."

The A. brothers probably thought that their wealth and status would shield them from any consequences. The thing is, that what they did is, unfortunately, not uncommon. In fact, it is so common that they couldn't believe they, of all people, could be arrested. JMO

Where are the Alexander brothers from? It's possible their family financed their studies.
I believe they had the intellect to complete a bachelor's degree, which is quite commendable. Joining the family business is not uncommon. And their combination of degrees makes them a perfect trio for all kinds of ... business.

Back to A. brothers. Let us move away from obviously criminal cases (minors, spiking drinks), and deal only with adult women who monetize their services. A couple of posts here, later removed, were along the lines of, these women knew why they came to the parties, what’s the problem now? It put me on another trail. If we had certain regulation of sexual “services”, the women whose cases may not be valid because it happened before 2017, might have still been able to sue the brothers, if not for the rape, then for the breach of contract. After all, when the As sell houses, they are protected by the contracts. Their marriages are contracts. Security company is contracted. But the women whom the brothers abused are not legally protected. If they were, maybe A.P. could still have a case because who knows the statute of limitations on the violation of contracts in the state of NY?

Any service is a contract. We all respond to the brothers’ situation from the standpoint of its moral ugliness. (But this might be the biggest pitfall of the case; emotions wax and wane.) But if the twin brothers switch places unbeknownst to women, isn’t it a violation of a certain contract? What woman would consent to the “train” activity? What if the brothers videotape their encounters with the women without any consent? When they initiate sexual encounters with women who are inebriated to such a degree that their consent means nothing, is it even legal?

Basically, in some lawsuits the brothers are accused of being “violent” during encounters, and sadly, one can imagine how it proceeded. That’s where the contract could help. If one is afraid of even putting what he plans to do on paper, maybe it should hold him. Also, the irony, verbal consent expressed on videocamera could be legally binding - but of course, not if a woman’s speech is slurred and she doesn’t understand where and who she is with.

The A brothers are sued for violating the law. The illegality of SW makes such violations more possible. JMO.

I think i understand where you are going with this but i think the problem is that criminals don't follow the law, lol... IMO I don't think the accused would have stopped if a contract would have been the law. They wouldn't have done up a contract then because these weren't contractual situations, were they?
Is there any evidence of any contract between any of the victims and the accused?

Criminals don't follow the law, but any service is a contract. I am sure that 17-year-olds for whom the brothers bought wine and then brought to their lair are a criminal case. Or the female colleagues who are suing the As have the case. Or women who merely expected to have a pleasant date and instead got violated. But the ones who are lumped under "trafficking" are on the mercy of the state of New York's statute of limitation for rape. IMHO, the nature of their job shouldn't matter; maltreatment is maltreatment, and threats are threats.

But you are right; breaking a contract has even a shorter statute of limitations so even from this standpoint it can't be used.

Interesting precedents came to mind, though, such as the first of Joan Barry's lawsuits against Charles Chaplin (before the paternity one). I understand the accusation equals to what would be called "trafficking" today.

Of a more recent time, there was a known lawsuit for breaking a promise to marry. There was no paper contracts or texts to confirm, just gifts, but perhaps a settlement would have been possible if other things didn't happen.
