Someone upthread said that the PA knows what is under seal, just noone out side of the PA, DA and judge. Was Nurmi under the impression that Juan would just sit there and take these accusations and not defend against them? I think it's all a part to delay, delay, delay because he knows this is a BS attempt for a mistrial. jmo
It was me (post 2191) and here's what i said:
Why are all of you under the impression that PT is unable to see what motions DT is filing?? Unless it's some weird Arizona law, in my trial experiences, "Under Seal" means only the Judge, counsel and parties to the suit can see it. I know an affidavit can be filed under seal if the subject matter is subject to atty-client privilege, but even then you submit a redacted copy to opposing counsel!
It just doesn't make sense to me that one side can file an entire motion secretly without giving opposing counsel a chance to prepare/respond - seems extremely unproductive!!
