Why do you think that? They appear to have some e-mails that they may want to have him read to the jury. He's been on the defense's witness list for a while, apparently.

Ok. He said that if he's subpoenaed he will cooperate and comply with the process and there's no reason to think he won't. No reason to doubt the credibility of his testimony in advance.

What emails are we talking about?

Sorry for jumping in here at the end of the day, but I was reading a news article that mentioned questions from juror implying that they aren't completely sold on JA killing TA (which I don't get since she already admitted to killing him). What did you guys think? (I wasn't watching). TIA!

I only try to give an honest debate from the defense perspective. Gives the right side a way to vent.

How about coming up with a WS "gang sign"? Something to flash when you know the camera's on you. Something discreet. Like flapping your arms 6 times and clapping once. Let me know. Keep it simple. :)

You know those cameras are so far away there's no real way to know where they are pointing. I will come up with something though and just do it randomly throughout day. :rocker:

CH replied to a TA email where CH possibly stated he didn't approve of the way TA was treating JA. We haven't heard all the details of the email just that snippit.

Chris is entitled to see an entire document already entered into evidence, just FYI
I was being facetious. Some found Chris belligerent when I would argue Gus was much more so.

I actually agree with you m00.. they entitled this afternoon part of an evidentiary hearing (continued from yesterday)

not sure if it is evidentiary in terms of what will be allowed in the defense CIC or evidentiary in terms of prosecutorial misconduct allegations

(btw, it is always good to see both sides represented in discussion and we are glad you are here posting with us)

I don't really take sides, ftr. (Not implying you're saying that, either!) I just try to remain as impartial as possible and exercise my critical thinking skills, if that makes sense. I'm always glad to be a part of the discussion.

he was given an email to read... questioned about it.. said he had to review it.. and the argument went behind closed doors at that point

I don't think it is a "gray area" at all. It is obvious that he was definitely playing with fire but he paid for it with the ultimate price.

That is the "gray area." You just articulated it the same as my coworker. He noted it, same as you.

i thought you could only plead the 5th to use against self incrimination?? and once you call the 5th, can't you no longer answer questions??? you cn't pick and choose which question you decide not to answer once you plead it can you?

Not necessarily. If a defendant exercises their 5th amendment right, they don't testify at all. A witness like Gus could answer some questions and plead the 5th when answering a question would incriminate him.

Slightly off topic...

I bet I'm not the only one who loves Juan Martinez now! I sense an increased appreciation for him after he ripped Mr. Gus a new one.

I'll try an opposing view... try.

- there will be other aspects to the supposed abuse (mainly only verbal/txt evidence IMO) and the anal aspect probably too.

- the pics in the shower are not important to the defense IMO except they show she didn't kill him. The defense should/could say that he didn't verbally abuse her or physically attack her... just saying.

- it seems to me (I may be wrong of course) that Travis sees her at one point taking pictures before being shot/stabbed. This guy obviously saw her too. I still can't understand the sitting down part... but that may have just been resting since he couldn't fall asleep with psycho over.

- IMO the vile part may be something in addition to the anal.

- The gas cans are TUFF to argue... but I will try.

* Didn't want anyone/family/payor to see any gas charges somewhere she shouldn't be or didn't tell him/her/them.
* Wasn't sure if would have money at a certain point on her card(s)... unless she or someone made a deposit.
* Paranoid (in addition to psycho) about gas. Always have to have extra gas in her car because doesn't trust gas gages and might be in desert.

Her defense is getting slapped around... but then again she left them with nothing but red flags and poison arrows.

Yes, they are good. In the respect that they set up a foundation for Juan Martinez to bulldoze straight through, strengthening his case. :seeya:

He didn't deserve being killed/murdered. I can't say he "did nothing," because I certainly don't know. He didn't appear to attack Jodi on 6/4/08 and she had no reason to think her life was in danger, and even if she did think that, she could have gotten away, so self-defense doesn't fly.

He didn't do any more than many many men have done. He liked the sex but he didn't want to marry her, and he couldn't quite let her go because the sex was too enticing. It's not that unique really. Might make him a bit of a jerk but hey, he was a young, single man. He also wasn't a psychiatrist so he had no idea the level of crazy he was playing with.
