The poll is really hard to answer in this case because there are so many ups and downs. My mind changes daily whether he's alive or dead lately!
 
Her words and actions are a pretty good circumstantial case that indicates she killed him.

whats her defense going to be if she comes to trial-I was just messin with Logan? But no I am not going to tell you where he is??? Without her testifying, her attorney will be hardpressed to explain her behavior. With her testifying and NOT saying what she did with Gabriel, I think we will have the same result....JMO.
 
Sorry for the back to back posts-I view her as speaking a kind of "Casey Anthony" style truth....there is a kernel of accuracy in the words that she has spoken or written...it is just figuring out what the kernel is. Maybe he wasnt dead when she put him in a dumpster. I am not trying to hurt anyone, I am just trying to work out what I think....
 
IMO, I think Gabriel is worth more to EJ than a deceased one. However, she has a history of violent temper tantrums that could have easily gotten out of hand. I pray this baby is alive and well and will be found safe very, very soon!
 
I voted "yes," but only because I think it's more likely that she killed him than that she gave him to somebody. I still have some hope that he's alive, though it is dwindling fast as time goes by.
 
I think the pole should be taken down. I feel it is disrespectful to the family. If it were my child, I would not like to poll whether people felt my child was alive or deceased.

So true about the parallels to Casey Anthony. IMO, both Casey and EJ are "spiteful b*tches".
 
If she was having a tantrum, someone would of heard her and called police. The hotel room was not destroyed. She seems like the yelling type. She seems to have these tantrums only in front of Logan. SHe acts like a child around him.

But Tammi called the judge on 1/4, so I think TPS knew where Gabriel was on that date.

"On 01/04/1010, Judge McVey telephoned the T.P.D. He provided me with a voice message which was left by Tammi Smith. I recognized her voice due to my previous interviewing. In the recording, Tammi Smith requests Judge McVey return her phone call. Tammi states that she believed that Elizabeth would return with the baby if she could know that Gabriel would be "safe." Tammi then suggests that Judge McVey grant the Smith's guardianship."

I don't believe she called on 1/04/2010. That is the first day back after the New Year's holiday for most people...possibly the judge took the rest of the week off after the emergency hearing too. Or he might have been called in for the hearing but was on holidays that week. And it was a message that he provided. It could have been left anytime during the previous week and maybe he just picked it up on his first day back after New Years?
 
I'm going to defend the poll. We're discussing a case and sharing our opinions. This poll allows us to measure how our fellow posters are reacting to the information we're finding and analyzing. This kind of poll has always been allowed in the past.

It's interesting to me that the majority believe Gabriel is alive. Even though, I tend to think EJ killed him, I do respect my fellow posters' opinions and, if the majority think he's alive, I believe there may be a good reason for it.

Thank you for pointing this out Danisisa. After thinking about it and how I would feel in their position, I think the poll should be taken down as well.

I don't know if this helps or not, but the charging doc mentions a reporter:

Tammi later stated a media reporter told her to call Judge McVey (this was her response to the message which she left). When I asked Tammi further specific questions about the reporter, Tammi could not recall if the reporter actually told her to call Judge McVey.

Tammi's first news interview was Sunday, January 3.

I don't know when they recorded that interview, or even if that reporter is the one Tammi refers to.

In any case, I don't think it's a definite indication that Elizabeth didn't harm Gabe. Tammi may simply have believed or hoped that Elizabeth hadn't harmed him.

I understand why the poll was done. With ever changing information it was a reset to see where people stood, but I also agree it should be taken down. I think posting theories and thoughts is different than a yes/no, quantitative poll. It's almost dehumanizing?? Not sure I am articulating that right. I say this totally respectfully, like I said, I do understand the intent. I know no harm was meant and everyone on her is just looking for answers to find Gabriel.

There is a forum for family-friendly posts, the Missing Persons Information and Support forum. The Discussion threads are not necessarily for family viewing. Here's a post from hoppyfrog in the Cheryl Kanning thread that explains further:

I haven't seen WS censor threads in the Discussion area to spare the victim's family's feelings or the emotions of posters. I'd say many of the posts in the discussion forum would be upsetting.
