I just think that if little Gabriel was still alive and EJ really DID give him to an adoptive couple, then she (EJ) would throw up her hands and cut a deal to reduce her sentence to get out of jail.

I think the reason she isn't talking is because she did the unthinkable and she is hoping that as long as they don't recover a body, then she won't be charged with murder.

HOWEVER, I hope that she IS talking to the police and they are just keeping it under wraps with hopes of finding Gabriel alive!

Then she would get Human Trafficking.

I just don't believe sweet little bably Gabriel is dead. And I think the text that EJ sent to LM could well have been another one of the many bread-crumb-trails that I think were purposely left to confuse and throw LE off IFanyone started looking for Gabriel. Since TS seemed to think LM would just disappear when this all first started, she might not have ever expected it to mushroom into such a huge case but she had EJ leave a message in case--I doubt she expected EJ to go into quite so much detail though. There are lots of other purposely unclear things... cell phone pings going south, two hotels in SA, two names used in SA, leaving a car, EJ going in a whole different direction. IMO, the text was sent to make sure LE spent all their time searching a landfill while Gabriel got even further away from home. Just a hunch.

When TS talks it seems like she wants to get caught looking like she's slipping up--it keeps everybody running and most likely, it keeps all of us running away from where he is.

Maybe someone has talked and LE is keeping to themselves for now.

LE hasn't come out lately and said EJ isn't talking which kind of makes me wonder.

Either accidentally or on purpose.

If he was alive-I think that he would have been found by now. He could have been over dosed.

I am furious with her for not talking. In certain cases I think water boarding should be allowed and used to find missing people. People like Misty Cummings, Casey Anthony and this witch. Bet that would get them talking real quick. JMHO:furious:

Baby Gabriel search now a murder investigation
Chief of Police McManus said new information that the baby was murdered and dumped in a landfill has turned the search into a murder investigation
http://www.kens5.com/

THIS IS HORRIBLE NEWS!!!!
Why did it take them THIS LONG to do this? WHY!!!

Her psychopathic personality fits right in with other women who kill their baby. For that reason, I say 'yes' she sure did kill her child.

Eliz doesn't see the difference between murder and giving the child away to strangers (an act of hate). She just doesn't get it and wonders what all the commotion is about! Taking care of life or ending life depends on her use of life at the moment.

Telling the father she put the dead, blue, body in a diaper bag and in the trash - is a cold, hateful, and calculating statement, again showing she will use the baby to meet her needs. To Eliz, the baby has many uses, all for her convenience.

Cruising through Craig's List for a babysitter and bringing her to your motel is the most obvious of her reckless acts. Telling the babysitter to 'drug' the baby if he gets fussy is even more irresponsible. Can't help but wonder if she was setting the babysitter up. When it comes to an agenda - danger is conveniently absent from her vocabulary.

Eliz's arrogant, self-centered, risky, manipulative and calculating behavior makes it hard to imagine why she ever had a baby in the first place. All just MOO

BBM. See, this is where I believe differently than most others. I don't believe she is a sociopath/psychopath. And the fact that there was no one there to show her is part of what gives me hope.
That last set of pictures, with the clothes and the toys, the food on his shirt to show she was feeding him...there was no one there to supervise her or give her a frame of reference, but she still fed him, changed him, dressed him and gave him toys.
EDIT: Doesn't seem like she gave him any severe beating either, as I was sort of figuring she would have. There were no facial or leg bruises visible in the pictures.

I agree totally with this observation.

Also, I cannot imagine it taking so very long to search a landfill if investigators did not have plenty of hope and belief that baby Gabriel is alive. Afterall, Sommer Thompson's body was found rather quickly in a landfill.

I would just bet that LE will dangle a supposed conclusion of murder in front of EJ to get her to talk. And I hope that they dangle that same conclusion with TPS as an accessory to get her to start being honest. If both TPS and EJ know they could be charged with murder- well, there is a better chance that they will each throw each other under the bus and SCREAM "No! We canNOT be charged with murder! Because he is alive! Here is proof!"

Ok- do not bash me guys- wishful thinking on my part- I know....But that would be the perfect ending for me on this one...

There are a number of comments in this thread regarding Elizabeth not talking, and how that influences our opinions of whether or not she harmed Gabe. My personal opinion is that the less a person talks, the more likely they are guilty.

Previously LE stated that Elizabeth had said nothing except to ask for water or to go to the bathroom. There is now a document from LE that states Elizabeth has talked more than that. It is Tammi's charging document from when she was recently arrested, which states:

During an interview with the F.B.I., Elizabeth stated she gave Gabriel away to an unknown couple. During an interview with the F.B.I., Elizabeth was very vague with her description of the unknown couple. Elizabeth stated she met the couple in San Antonio, Texas, at a park.

Additionally, from Feb 3, shortly after Tammi was arrested, is this video interview with Steve Carbajal of Tempe PD. I've transcribed the relevant statements:

Reporter: What about the mother, Elizabeth Johnson. Is she now cooperating at all?

Carbajal: She is not to the best of my knowledge. She has an attorney like we've said before. So her attorney is speaking with the county attorney um... and I know they're trying to get some information, or at least proceeding with the charges that we have currently in place so that, that's what's going on with that.

Reporter: Has she been able to corroborate any of the information with regard to Tammi Smith?

Carbajal: Um... Hasn't really spoken to us about Tammi Smith that I'm aware of specifically um... but obviously, that's information that we're trying to obtain and, and there are some conversations between the lawyers that are going on.

I pray that Elizabeth did not harm Gabe, and that she is giving information that may help find Gabe and return him to his father and family.

This does not appear to be a direct quote but at the end of this video (~2:29), the reporter says SAPD requested to speak with Elizabeth and her attorney said no. http://www.woai.com/mediacenter/[email protected]&navCatId=5

I just really hope she starts talking. Hopefully a murder investigation can help propel her to do so.

If she murdered Gabriel, by definition, it's capital murder in both states. She will get the needle.

TS: I would have been in, and, and he knew that she was in, he knew she was in a hotel, with that baby, refusing to come back, and telling everybody she was going to change her identity and his identity, and she’s never gonna call us back again. I mean, come on, did he not want to find his baby?

That quote is from when Tammi got out of jail. It's really been bugging me. I wish I knew when Elizabeth said that. Because if Elizabeth said that prior to the 26th, maybe even on the 26th, then I would have much less reason to think she harmed Gabe.

I would do anything to know when she said that. If she said it.

ETA: Yes, yes I am obsessing over every little minute detail of this case.

Was this when EJ told the Smiths that she had a job and her boss was helping her with a new idenity? When she was already in FL? As I recall, she seemed to let TPS assume that she had Gabriel with her.

I don't know. She told her grandfather before she left Tempe that she was going to change her own and Gabe's identities. That's what's making me think it may have been earlier in the week in SA.

I hope he is still alive. If not, I hope she has nightmares even when wide awake.
