DNA proves Cobbins ejaculated sperm but not how it got in her mouth.

DNA Does not prove Cobbins caused physical injury.

DNA Does not prove that he killed her.

Day 4 is a wrap and amazingly the state probably will rest its case 2morrow bot not b4 grisly autopsy stuff

Cuttings from mattress in Davidson's room had Channon's DNA, none on Cobbins' mattress

IMO the DP is looking grim. So far the prosecution has only been able to prove what Cobbins has already plead guilty too. At first I thought it was a really stupid move for the def to plead but now I see their strategy. Although we all know Cobbins played more of a part, I think the def looked at the DNA evidence and basically copped to it and in doing so said, "now prove he did more.".. which it does not look like they can.

What I cant get over is that all of these defendants played a role in the kidnapping, torture and murder of these two young kids. I thought the law was if this was the case, it really did not matter who pulled "the trigger" so to speak. Of course they can all blame each other for the actual killings.. how is the prosecution supposed to pin down exactly which one did it? They ALL did it.. Its very frustrating.

It doesn't matter who pulled the trigger on Chris or who put Channon in the trashcan. They all participated in a crime that led up to it. That's why they are all charged with Murder under the Felony Murder Rule. Cobbins has already plead guilty to crimes that fascilitated the murder. So really the only question is will he get LWOP or the DP. If you notice it's only the defense that's making the point of who was more involved than the others and painting Cobbins as the least responsible. The way the charges are, the prosecution only needs to prove Cobbins was involved in a crime that fascilitated the murders not who actually commited them. At this point the defense is merely trying to save his life and get their client LWOP. IMO of course.

This is why the judge was asking Cobbins...are you SURE you want to plead guilty to rape, kidnapping and theft?
