GUILTY TN - Evelyn Boswell, 15 months, Sullivan County, 26 DEC 2019 *MOM ARRESTED* #10

Oh crap, ME just stated there was a defect in Evelyn’s heart valve. Defense is going to run with this IMO.

  • #302
Wow… that heart thing came out of left Field… Defense is jumping on that

Wow she's uneasy on the stand but we get that sometimes defects don't mean real issues going on. She says these usually heal by age 4.

Oh, sweet baby.

Heart defect.

Defense is belaboring a point. Her septum hadn't closed.

ME rules out the defect contributing to her death.

(Seriously, Defense wants to say she died of heart issues or SIDS.) In a trash bag. Upside down.

  • #305
Yeah, Evelyn happened to be in a trashcan upside down when her heart failed and or she died from SIDS???

  • #306
now he is harping on possibility of sids

  • #307
Now defense is going on about possible SIDS death.

How insulting to the jury. To discount their intelligence this way

Sounds about right -- 12/27/19, HW likely wondering why this mother of a 13 month old child that he's known for barely a month appears footloose and fancy free, exhibits little to no interest in seeing her child. Her only interest seems to be spending time with him.

MB gaslights HW -- tells him EB is with EP, and she doesn't want to bring her home because they're not a 'stable couple' right now! Grrrr...

FYI I'm not a doctor but I believe that septum deal is not unique, often babies have it and it closes without incident or only becomes noted later.

No reason to think that it would have been fatal issue.

But sure, the Defense will exploit this.

Yes, when your child dies from some ailment or illness you wrap it's head in foil and put it in a trash can inside a plastic bag upside down and leave the body to rot for months. Just like any good mother would do.....

Defense is hammering ME.

ME does not make her determination based on autopsy and the totality of circumstances surrounding her death.

He is asking her to show where in the autopsy....

But she did a forensic autopsy.

She used all available information.

Sigh, I know defense is just doing their job but it still ticks me off. All the medical issues Evelyn had could be markers for a natural death but you’d have to really push it. There’s enough evidence to support homicide; let’s hope the jurors conclude the same. JMO

MOO

Leaves in her hair.

Leaves in the shed.

Leaves were inside the tinfoil.

Not sure the Defense's point but thank you, keep telling us how little regard MB had for the daughter she discarded.

There it is. The homicidal violence is the positional asphyxiation.

ME cannot say whether the child was dead or alive when placed in the trash can.

  • #316
She had a heart defect? Did we know that?

Yes, and not unusual for preemie babies and generally heal without intervention.
Hope the ME clarifies this. I recall MB stating that EB only weighed 5 lbs at birth. I think we have this screenshot archived on WS from MB's Facebook. MOO

And no redirect after the ME mentioning a heart defect?!

Hate to say it, Score 1 for the Defense.

If Evelyn died in the trash can, homicidal violence is obvious.

But if she was already dead, then the finding of homicidal violence doesn't fit. So she could have died by another means.

The fact that MB didn't bite on accidental death, however, tells me it wasn't accidental.

Second ME coming up? Toxicology report?

Sure... and mothers naturally lie for 90 days and accuse everybody they know of foul play when their toddler succumbs to an unexpected, but natural cause of death.

2nd ME, Asphyxiation death, homicide.
