Witness: Matt Price Pt. 2
Price told Harper that after Boswell began directing police to look into her mother, gears shifted for the people searching for Evelyn.
Price and Gratz interviewed Boswell again at the sheriff’s office on Feb. 20 after Tommy Boswell, her father, arrived. The jury was shown a recording of that interview as well.
In the video, Gratz sits in the room while Tommy and Boswell speak. While Tommy asks what is going on, Boswell states that the police have what she has told them but does not share many details about the investigation or Evelyn.
Tommy told Boswell to tell investigators what she knows, and Boswell eventually reveals that police are looking for Angela.
“Your mom don’t have Evelyn,” Tommy said in the video.
Tommy repeatedly indicated to Boswell that he did not believe her about Angela having Evelyn, despite Boswell’s claims that Angela has even told her she had the child.
“You keep digging your hole deeper, honey,” Tommy told his daughter at one point in the video.
Boswell repeated that Angela wanted her to go to Virginia with her, and the BMW Angela was believed to be in was described.
Throughout the interview, Tommy advises his daughter to tell the truth about what is going on.
“The truth will take you further in this world than anything will,” Tommy told Boswell.
Boswell told Tommy the last time she saw Evelyn with Angela was in December when she claims her mother took the child after staying a few nights.
Tommy told Gratz that he spoke with Angela on Feb. 17, 2020 when she brought one of their other children to him at a meetup in a parking lot.
Tommy advised Boswell to be honest if some accident had occurred involving Evelyn. He told her that he would love her regardless of what has happened, but things would be better if she came clean.
“It’s gonna come out, it’s just a matter of time,” Tommy said in the interview.
“Dad, I swear to God, I just told them the truth,” Boswell responded.
Tommy warned Boswell that Angela would do anything to help herself, but he continued to say that he did not believe his daughter had been totally forthcoming.
“Don’t get mad at us when I say this, but I don’t think you’re telling the truth,” Tommy said.
Boswell maintained that she thought her mother would take off with Evelyn if she got police involved.
Boswell then asked Gratz to leave the room to speak with her father, and the agent left. The video continued to record.
Boswell began to claim that her mother accused her of taking money off of Angela’s birthday. She said Angela then came to stay with her and watched Evelyn for a night in mid-December. Boswell told Tommy and later Gratz that her mother and Evelyn were gone when she returned one day after staying with Wood.
According to Boswell, Angela then told her that she had Evelyn and would give her back when Boswell paid her back for the debit card money.
Tommy asked Gratz how many different stories Boswell had told police, and Gratz said he was not sure.
Boswell also told Gratz that her mother had family in Oklahoma and had threatened to go there in the past.
After Gratz and Tommy leave the room, Boswell appears to start biting her nails and holding her head with her hands once left alone.
After a short time left alone, Gratz and Price return to the interview room and asked her how much money Angela was asking for. Boswell said she was not sure how much because she had not taken any money from her mother. She told the investigators that the last time she saw Evelyn was the night before her mother supposedly left with Evelyn.
Price and Gratz tried to put together a new timeline with Boswell saying Angela came to stay with her on Dec. 7, 2019 and took Evelyn about a week later. She said Angela then called her on Jan. 9, 2020 while she was working at the Chicken Shack.
Boswell told them she met with her mother in Elizabethton the same night that she called, but she claimed to not see Evelyn that night. She said she was not worried because Angela told her that Evelyn was safe wherever she was, despite not having seen her daughter in roughly a month. Boswell claimed she and her mother did not have contact between Angela taking Boswell and the Elizabethton meeting.
Gratz asked Boswell if she had asked Angela for any pictures of Evelyn. Boswell said she did shortly after meeting with her mother. She said she did not get a photo from her but spoke with Angela on the phone on Jan. 10, 2019. Her mother told her she would send one to her but never did, Boswell said. Instead, she claimed her mother showed her a physical small picture of her in person instead of showing her the child.
Gratz asked her how she went from being “obsessed” in a good way with her daughter in October 2019 to being fine without seeing her for a month. Boswell told him she was worried her mother would flee the area with Evelyn if she got anyone else involved.
Boswell told them in the video that she stayed in constant contact with Angela after that point but did not see any further pictures of Evelyn or hear her daughter over the phone.
Boswell reiterated that she did not want her mother to disappear with Evelyn, which is why she did not tell the police about the situation before.
Gratz asked her in the Feb. 20, 2020 interview about her relationship with Wood and how he felt about Evelyn. She told him that Wood never really brought up Evelyn or asked about her whereabouts. Gratz asked her what her phone’s photo background had been before when she had a phone, and she said it was a picture of Evelyn; however, she told him Wood never brought it up.
She went on to describe a timeline of the time when she said Angela had Evelyn. According to Boswell, she and her mother drove around at times and also attended a Super Bowl party all while Evelyn was supposedly being kept away from her by Angela.
Boswell claimed she repeatedly asked Angela where Evelyn was, but her mother never told her. When Price and Gratz expressed disbelief that Boswell was ok with not seeing or knowing the whereabouts of her child for over a month, she said she did not think she had many options.
Gratz asked her if she had reason to believe that Evelyn was dead, and she said no. He asked her what reason she had to believe she was alive.
“Hope,” Boswell answered.
She told Gratz and Price that she did not know how they could have gone about finding Evelyn, and Gratz said he knew how they could have found her if she contacted the police earlier.
Gratz repeated back to Boswell that she had seen Angela almost every day since Dec. 14, 2019 but never Evelyn. He asked what would happen if they found Angela that day on Feb. 20, 2020 based on what Boswell had said. She told them she was not sure.
Price told Boswell she had caused them to waste time and resources by lying to them up until that point. When asked by Gratz, she admitted that she knew Evelyn was not with Perry when she gave that story to them.
Witness: Matt Price Pt. 3
After the video finished, Price told the court that the Feb. 20, 2020 was the first time Boswell told the story that Angela had taken Evelyn. He testified that Angela and her boyfriend were found in Wilkes County, North Carolina, but Evelyn was not with them.
Price said there was no evidence that Angela had ever had Evelyn with her.
On Feb. 21, 2020, Price and Gratz interviewed Boswell again and confronted her about the inconsistencies she had provided them with. According to Price, he and Gratz were attempting to establish a timeline as to when Evelyn was last seen alive. They also had taken evidence from Wood’s home, including items from a “memory box.”
Goodwin told the jury that because of the length of the video from the Feb. 21, 2020 interview, they would take a short recess.
When the jury returned shortly after 3 p.m., the video was played on the screen.
Gratz and Price can be seen laying several items out on a desk in front of Boswell. After agreeing to an interview with them without an attorney, Boswell began to identify items.
She started assigning dates to photos from the memory box that Gratz held up. The photos depicted Evelyn at multiple events and on trips with family members. Among them were pictures from when she and Evelyn visited Ethan Perry in El Paso, Texas, an event Perry described during his own testimony on Friday.
Gratz and Price also asked her for times when she and Wood took a trip to North Carolina together and placed photos from then on their timeline. A receipt from that trip placed it on Jan. 19-20, 2020.
In addition to placing photos on the timeline of Evelyn’s life, Boswell also told investigators about how the child liked to go to Warrior’s Path State Park and a Bluff City dinosaur attraction. She also told them that she and Evelyn celebrated her first birthday alone together at her trailer with a cake for Evelyn to smash.
Gratz pointed out in the interview that Boswell was good at placing dates about Evelyn right up until around Dec. 20, 2019.
Gratz showed Boswell a card she wrote to Wood, apologizing over a fight they had been having with no mention of Evelyn.
Gratz told Boswell that his point was that she knew all the dates and saved numerous moments from Evelyn’s life up until Dec. 20, 2019 but then they stopped.
Boswell was asked about why she took trips instead of looking for Evelyn, and she told them she did look some. She maintained she believed that Angela had her.
Gratz told her at that point on Feb. 21, 2020 that he believed Boswell knew where Evelyn was and that she was dead. Price repeatedly told her that the story did not make sense and that they knew she was lying to them.
Gratz brought up an application for Boswell and Wood to live in an apartment with a third person. That application was entered into evidence previously in the trial, and Gratz said Boswell had said the third person was her and Wood’s unborn child.
Price and Gratz then tell Boswell that Angela has told them she never had Evelyn. Both investigators then tell Boswell they do not believe she is being truthful despite her repeated claims otherwise.
Both men appear to become angry with what Boswell is telling them and her reaction to Evelyn’s disappearance. They told her that she was no longer a credible source because of the lies they said she had told. Both questioned if she cared about Evelyn.
Price told her all the specifics she had about Evelyn seemed to end around the time she and Wood started dating. Boswell continued to point them in the direction of Angela and insisted she was telling them everything she knew.
Price and Gratz told Boswell they thought she was at peace with whatever happened to Evelyn based on her behavior. Price said as a parent that he would be out in a snowstorm looking for one of his children if something happened to one of his children, yet he said she was going on trips, visiting an aquarium, eating out and spending time with Wood instead.
Gratz said in the interview that if Evelyn was alive at that time, which he said was a big if, then she was not safe. Gratz told her that the last credible sighting of Evelyn, verified by other people, was around Thanksgiving 2019., to which she insisted Bailey Hawkins could verify a trip to the Speedway in Lights. Hawkins was previously called to the witness stand.
Witness: Matt Price Pt. 4
After the video’s conclusion, Harper continued to ask Price questions. He asked Price to identify further pieces of evidence, including three pillows, one of which was recovered by investigators at Boswell’s former trailer home and two of which were found at a shed on Tommy Boswell’s property.
Boswell’s attorney Gene Scott began cross-examining Price and asked for a timeline of the interviews he and Gratz conducted with her. Price told him that she was read her Miranda Rights before each interview.
Price said during the investigation he did not recall ever visiting Boswell’s trailer home on Sugar Hollow Rd, but he was at Tommy Boswell’s property on Muddy Creek Rd the night Evelyn’s body was found and had returned to it multiple times since.
Scott asked him if he ever believed Boswell in her interviews. Price said he did not think she was ever being completely honest though he thought she might have given pieces of the truth at times.
Scott also asked Price if he ever interviewed Wood, to which Price said he had little interaction with him and also knew Wood from a professional stance.
Price told Scott that when he became aware of Wood’s mental health problems, he spoke to the district attorney’s office but that it was not part of the investigation when police were first searching for evidence. He also informed Scott he was not present at Boswell’s Sugar Hill Rd property when it was searched with cadaver dogs.
Harper resumed his questions and asked Price about the drone footage taken of Tommy Boswell’s property, which Price helped collect. Harper then asked what the distance from a trailer on the property to the playhouse was on the property based on that drone footage. According to Price, the two structures were just over 50 feet from each other.
Scott resumed questioning Price, who confirmed the SCSO did provide Boswell with a cell phone for communicating with them. Price said the cell phone could have been used to track Boswell, but he was not sure if it was ever used for that purpose.
Price was released as a witness.
Witness: Jay Quaintance
The next witness called to the stand was Jay Quaintance, News Channel 11’s news director. Quaintance was the news director at WJHL at the time of the search for Evelyn.
Quaintance confirmed that WJHL covered the search for Evelyn and that Boswell was interviewed by the station on Feb. 24, 2020. News Channel 11 provided authorities with a copy of that interview, which was entered into evidence and played for the jury.
In News Channel 11’s interview, Boswell told Anslee Daniel that Evelyn was a sweet baby who loved everybody. She talked about Evelyn’s behavior and advancement as a child and her love for Baby Shark.
She claimed that she told the TBI that Angela had taken Evelyn to Mendota and left her in a silver camper and that she would go get her that night if the authorities did not. She said the TBI was not taking her seriously.
Boswell told News Channel 11 that Angela had taken Evelyn but assured her the child was safe.
“I just want her back that’s all I want,” Boswell said on camera.
Boswell said at the time that she had been cooperating with the TBI and SCSO.
“I will go find her myself,” Boswell said in the News Channel 11 interview. She claimed the authorities were not taking her seriously and that she would go look despite allegedly being told she could be charged with tampering with evidence.
Boswell declined to speak about her relationship with Wood. She did say that Perry was attempting to be approved for leave from the Army to come assist in the search for Evelyn.
The state and defense had no further questions for Quaintance after the video was over, and he was released as a witness.
Witness: Keith Weiss
The next witness called was Keith Weiss, the news director of WCYB-TV. Weiss said his station also interviewed Boswell outside of the sheriff’s office in 2020.
He told Harper that WCYB also provided law enforcement with a copy of the Feb. 21, 2020 interview, and it was played for the jury.
In that interview, Boswell reiterated that she just wanted Evelyn back and did not know where she was. She also claimed the last time she saw Evelyn was in December.
In that interview, she described the police, specifically Price, as being very nice and helpful. She again said Evelyn was a sweet baby. Boswell said she was hopeful that Evelyn would be found safe. Unlike the News Channel 11 interview, Boswell made several positive comments about the effort authorities were making to find Evelyn.
Weiss was released as a witness with no further questions from either side.
Goodwin sent the jury back to their hotel for the day after Weiss was released.
