Let's be honest. He really didn't do a whole lot of defending. He might have been writing the appeal while watching the COURT TV feed on his computer (seen on multiple days) during the prosecution phase. What can you defend.... her social media and those interviews speak volumes. He is looking for any crack of daylight in the case--- but there is not one.

Really, it's up to MB now. 51 years to face what she has done.

Maybe she'll surprise everyone, be a quiet and orderly prisoner, come before the parole board penitent and decent and be granted the second lease on life Baby Evelyn never got.

Or.... she'll continue to lie, manipulate, fabricate, triangulate, instigate and create head-spinning drama from the cool comfort of prison and will have the same credibility in 51 years that she has today.

I suspect we're looking at a lifer.

MB had an opportunity to speak to the Jurors before they deliberated her sentence. She could have expressed something, anything for Evelyn, and she did not.

She'd already been convicted!

Nope -- she's going the appeal route. No remorse, no regret, does not miss her baby girl.

Agree -- a lifer.

According to a motion filed at 2:41 p.m. on Thursday, Boswell’s attorney Gene Scott has asked the court to dismiss the charges against her or grant her a new trial.

“There was insufficient evidence in the record to support the Defendant’s convictions for first degree murder, 2 counts of felony murder, aggravated child abuse, aggravated child neglect, tampering with evidence, 11 counts of false reports, abuse of corpse, and failure to report a death under suspicious, unusual or unnatural circumstances,” the motion reads.

In addition to the claim of insufficient evidence, Scott claimed the multiple false report counts violate the protections against Double Jeopardy in the U.S. and Tennessee constitutions.

News Channel 11 spoke with Scott after the trial. He said despite backlash from people outside the courtroom, he stood by his defense of Boswell.

“It’s a sad case,” Scott said. “I know I’ve been criticized a lot in the media because of defending Megan, but everyone’s entitled to a defense and that’s what I hope I provided her, and I tried to do that to the best of my ability.”

The jury ultimately sentenced her to life in prison with the possibility of parole. Boswell must serve 51 years before she is eligible for parole, and a sentencing hearing has been set for May 22.

During that hearing, Judge Jim Goodwin could rule that the sentence on Boswell’s other 16 charges be served consecutively or concurrently with her murder sentence.

Sad to hear that she was raped, and crawling in lice when she was fostered :(

But knowing what they knew about her, why wasn't she closely monitored by child services when Evelyn was still little?

I agree that it is so sad what she had experienced. And, the fact that she was refusing to clean her room and adhere to house rules demonstrates that she was a mess on more than one level.

Not sure about paternity issues as it relates to a sexual assault. But, I am mindful that this young woman was manipulative of a number of the men she was dating--- it seems like with HW she went from just meeting to moving in way too fast. The young man she said had taken Evelyn was surprised by her showing up to Texas. Additionally, the whole Christmas --- who has Evelyn charade--- was so concerning that it is almost terrifying for any other kids in that family. Not once was she sad to anyone about not spending baby's 2nd Christmas with her daughter AND no one in her family seemed to press her on the lie of Evelyn not being there, how a court date happened, and how all of a sudden she disappeared. The soldier was lucky that he never met her for a "custody change" or "hang out" because she might have persuaded LE that he had done something to Evelyn--- as he would have been the last one to "have her" and it would have been documented.

I am never one to question a person's story when they say they were assaulted but her lies --in total and in volume-- give me pause. Opiates and poverty and domestic violence are situations that can cause a whole life to go off the rails.

I feel the same. But...I'm still going to hope the judge rules that her sentences for the other charges will be served consecutively. MOO

I'm ok with that sentencing as well.
51 years is a long time and she will still have to convince them that she deserves parole. Unless she can prove regret by that time, she won't be paroled.

Nothing will bring Evelyn back. Her mother is a horrible human being. But she's a messed up human being. I don't think she will hurt someone at 70 years old. She won't have anyone dependent on her at that point.

“In February 2020, baby Evelyn Boswell captured our hearts and became one of our own,” Cassidy said in the online statement. “Sullivan County Sheriff’s Office detectives along with our state and federal partners worked tirelessly to find her and build a case against the person responsible for her death. Thanks to their thorough investigation and to the hard work of our District Attorney’s Office, Megan Boswell was found guilty of all 19 charges against her, including the First Degree Murder of her daughter. Today, justice was served for our Baby Evelyn.”

Because that would be a complete violation of public trust and you hope that people understand their roles .

*Trial continues (Day 8)-VERDICT REACHED! (@ 9am ET) - TN – Evelyn Mae Boswell (15 mos. DOB 11/21/18) (last seen Dec. 10 or 11, 2019 by babysitter, Blountville, Sullivan County, reported missing Feb. 18, 2020 by State of Tenn. Dept. Child Services; Evelyn’s remains were found on Mar. 6, 2020 at a family member’s property at the 500 block of Muddy Creek Road in Sullivan County; officially id’d Mar. 11, 2020). *Megan “Maggie” Boswell (18/now 23) aka Maggie Wood aka Megan Nicole Kys “mother” arrested & originally charged (2/25/20) with 1 count of false reporting. Bond set at $25K. Bond increased (3/9/20) to $150K. [see below for re-charges].

2/13/25 Thursday, Trial Day 8: *Jury continues deliberations. Started at 8-9:30am. The jury could find Boswell guilty of lesser charges than the ones levied against her. If she’s found guilty on any of the three first-degree murder charges, the jury will also be tasked with deciding her sentence in a second trial that would begin immediately after.
*The jury found Boswell guilty on all three first-degree murder charges she faced in the death of her daughter Evelyn. She was also found guilty on all her other charges, including aggravated child abuse & aggravated child neglect.
Boswell faced 19 charges in Evelyn’s death. Those charges included:
First-degree premeditated murder – GUILTY
First-degree murder in the perpetration of aggravated child abuse – GUILTY
First-degree murder in the perpetration of aggravated child neglect – GUILTY
Aggravated child abuse – GUILTY
Aggravated child neglect – GUILTY
Tampering with evidence – GUILTY
11 counts of false report – GUILTY
Abuse of a corpse – GUILTY
Failure to report a death under suspicious, unusual or unnatural circumstances – GUILTY

*Judge Jim Goodwin sent the jury back for a brief recess before they immediately moved into a sentencing trial. Based on her first-degree murder convictions, the jury will determine if Boswell will face life in prison without the possibility of parole or life in prison.
*Boswell’s attorney, Gene Scott called defense witnesses: Angela Boswell, Megan's mother. Gail Kyte [was Boswell’s foster mother at the time Evelyn was born]. Mary Boswell, Boswell's grandmother. Boswell informed the court that she did not want to testify. Defense's mitigating factors: No criminal history, youth/age at the time, unstable childhood, DV in the home, drug use in the home, schooling, not seamless & death of her grandfather. Defense is asking for life with possibility of parole.
*The jury heard closing arguments before deciding whether to sentence Boswell to life in prison without parole or life with the possibility of parole. On the latter, she would be required to serve at least 51 years before parole could be considered. Prosecutor Amber Massengill gave arguments as did attorney Tim Horne for defense & Deputy DA William Harper gave rebuttal. Jury left for deliberations on sentencing @ about 11:30am to 1:30pm.
*The jury decided on a sentence of life in prison with the possibility of parole. The verdict means Boswell will serve 51 years before she is eligible for parole. The jurors were thanked for their service & released from the court.
*Sentencing for Boswell on her other charges will be decided at a hearing on 5/22/25 @ 1:30pm. At that hearing, the court will discuss the merging of some charges & the way in which her sentence is carried out. Attorney Tim Horne asked to be released as co-counsel from the case, which Goodwin granted.
*Boswell’s attorney Gene Scott has asked the court to dismiss the charges against her or grant her a new trial.

News Channel 11 learned Friday that there had been talks of a plea deal between the district attorney’s office and Boswell’s defense team, but they wouldn’t provide specifics.

“She appeals to the Court of Criminal Appeals and then the Supreme Court. That’s the once that’s done, she’s got ineffective assistance of counsel, and that’s about it,” Byrd said. “It’s not all the things that are built in with like a death penalty claim or a death penalty sentence that all the appellate protections that you have are not there.”

Normally, when a person is up for parole, impact statements for both parties are given.

“There’s really nobody to come and advocate for Evelyn unless it’s some of Megan’s own family that wants to come speak against her getting released,” Byrd said. “Once she goes through all this, I mean, she’s she’ll be off in prison until she’s up for parole. And who knows who’s even still alive by the end to come speak against her.”

There’s never going to be an “excuse” for what MB did, because it was absolutely unfathomably horrible, and she will deservedly have PLENTY of time to ruminate on what she did.

That said, the testimony from her foster mom about her getting custody of a 17 year old pregnant minor with severe lice and matted hair was also so incredibly sad to me, regardless of WHO in that situation “caused” her to be in that state. My takeaway from that part of the trial was that MB had negligent or disengaged parents AND almost certainly has some serious personality disorder and/or other mental illness. Which also means that this TEENAGER had NO BUSINESS being the SOLE caregiver for a NEWBORN, but. Yeah.

RIP, Evelyn. I’m sorry life was like this.

What 17 year old doesn't know how to comb their own hair? AFAIK she was in foster care because she was truant from school and her father couldn't get that lazy cow to do her chores or make her go to school. She still had energy, matted hair and all..haha...to get herself pregnant. She's a disgusting waste and manages to manipulate those around her. Just look at all the people that wanted to help. Anyone of them would have taken care of little EB.
