Brad Sproles, Boswell’s attorney, also announced that he filed two motions on Sept. 29 — one requesting to reduce her bond, which is set at $1 million, and the other asking for the judge to separate her indictments for a possibility of two trials.

“We are asking to sever some of the counts in the indictment from the other counts and provide her with two separate trials,” Sproles said. “There is a specific rule in the Tennessee rules of criminal procedure about severing offenses, and we believe that this case fits that.”

Staubus said that the Tennessee Bureau of Investigation will have the case’s forensic testing finished by November 2021.

“We’ve provided Mr. Sproles 87,000 images; 57 hours of video footage; 18 hours of audio footage; 28,000 text messages; and more than 24,000 pages of social media,” Staubus said.

Officials set aside other dates in 2022 — a motion day on April 7 at 1:30 p.m. and a pre-trial motion day on July 28. Judge Goodwin also set a motion deadline and jury questionnaire deadline for March 1, 2022.

Goodwin set the deadline for a negotiated settlement on June 1, 2022. This will give Boswell the opportunity to change her plea. She has pled not guilty to all charges.

Boswell is scheduled to appear in court next for a bond motion on Dec. 3 at 1:30 p.m.

I thought that per Tennessee law, first-degree murder is a Class A felony. Bond guidelines recommend no bond for that grade of

It’s probably poor manners to quote myself, but I found an answer to my question about bond in Tennessee. Not a death penalty case.

Under Tennessee law, every criminal suspect, except those facing a death penalty case, is constitutionally entitled to a bond. There are some exceptions to this, such as a violation of probation, or when the person is a fugitive from the law. In that case, a judge may issue no bond or an open court bond, which would hold the person without bond.

I see 2 dates for bond motion hearing in the article.

Boswell is scheduled to appear in court next for a bond motion on Dec. 3 at 1:30pm. Boswell's lawyer, Brad Sproles, has reviewed 800,000 photographs, 28,000 texts & other pieces of evidence. Sproles has made a motion to reduce Boswell's bond. That will be heard on December 7 at 1:30pm.

Yes -- I believe TN is similar to Colorado where each initially followed the Constitution and adopted no bond for capital murder (death penalty not required) unless exception such as PEPG is not met.

Thanks for your reply @Gardenkeep. I misunderstood your post directing readers to "see that discovery" as actual court information newly released. Yes - the number of images, messages, etc. is not surprising in this day and rivals many other cases.

IMO we’ll be seeing much longer wait times for all trials because of the digital, video and electronic evidence that’s available now. It’s mind boggling how much data there is for both sides to sift through. The upside is that is, it’s becoming very difficult for those who are guilty to evade justice.

Re-Charged & indicted (8/19/20) & arraigned (8/28/20) with 2 counts of 1st degree felony murder,

I'm sorry, I'm not that familiar with US legal terms; what does "Two counts of 1st degree felony murder" means? Does it mean that there are two victims (hence two counts)? And does it mean that murder took place during a felony?

No - not 2 victims - maybe @Seattle1 - can explain better. Since the court site doesn't really spell it out.

The additional murder and child abuse counts are penalty aggravators.

MB faces a total of 19 counts where counts 2 and 4 are imposed for added penalty where the murder victim was under the age of 12 -- an aggravating factor under TN law:

I think I've ran out of words on how this has got me.

I'm looking forward to celebrating my Granddaughters 2nd Birthday this Sunday, and what a Christmas we have planned for her. Baby Evelyn will be there with me, in my thoughts, in my heart.
