Do you think they were able to go over the questions with Samuels?? I thought the only reason they were discussed with Arias was to "aid in her defense". Is that correct?
There are two charges right now. 1st degree and felony murder. According to the verified attorneys, or at least one of them, the lesser includeds can be charged if warranted at the close of evidence. I believe that to be true because one of the cases Juan tried as 1st degree was later charged as 2nd degree or man (can't remember which) over the defense's objection. The defense's position was that the State charged 1st degree so should prove it. It was the case of the Suns' nutritionist and his ex-wife I think
Great list, Pensfan...
I'll add a couple:
- How often do you or your colleagues personally write out your client's test answers by hand on a legal pad rather than use the actual form that the client filled out themselves?
- Since you made several 'typos' that, if left as is, would have NOT resulted in a diagnosis of PTSD, how can we be sure that you haven't made other mistakes or typos that are this significant but have not been corrected?
- If the DSM-IV contained information that was known to be false, fake, misleading and/or made up,.. would you still use it as a diagnostic guide?
- Since you have made a diagnosis pertaining to JA, why did you not ensure that she received treatment? Or if you did, was treatment successful? How long did it last?
- Do you know if JA was evaluated upon incarceration, long before you first saw her? If so, why would her PTSD, or some signs indicating a problem go unrecognized by any mental health evaluation before yours?
- In evaluating JA, did you consider her to be a normal individual who suffered some trauma, or did you consider her to be abnormal (emotionally) who could fake trauma symptoms in order to avoid serious consequences?
- What is your experience with psychopathy/sociopathy? What behaviours indicate (to you) that someone may fall in this category?
- How can JA be so traumatized by the killing of Mr. Alexander and not be deemed in need of extensive treatment/observation?
- How did JA 'cure' herself of being suicidal and having severe depression, low self-esteem, especially AFTER being incarcerated, something one would think might *produce* such feelings or intensify them?
I just looked at her court records and the only charge listed is 1st degree. Here is the meaning of first degree. I think it may have the same meaning of felony murder.

Couldn't sleep. Come to see what the nightowls are doing. :seeya:
If you're trying to say that 1st degree is the only charge pending because that's what it says on the electronic docket, that would be mistaken. I'm sure others can vouch for the fact that the State charged and fought hard to keep its felony murder charge.
eta: the charges are not similar
Actually sadly, I heard one old woman call-into Vinnie Politan's daytime HLN show and she was convinced Travis was a pedophile solely because he did anal sex. So in her book pervert(anal sex)=pedophile.

I'm so happy you find relief with Excedrin! I wish it would work for me. Unfortunately, mine don't go away without the prescription medicine and even with it, they can last for days. I feel your pain.
I referenced Aspirin because it was rumored to be the pill JA took yesterday in court. Then, we have JA hoarding the Motrin/Advil for her Bic suicide attempt.
I still don't understand how the jail/court would allow a prisoner to take something in court without supervision. They are allowing this after she testilies to stocking up on Advil/Motrin to commit suicide.

Guys, it starts at 10:30 AZ time! Same as everyday! Don't be late, you'll kick yourselves!
They have different descriptions but both fall under 1st degree e.g. 1st degree premed and 1st degree felony. I believe that is the way its worded on the indictment or the charges. I'm trying to locate a link. However you are also correct I just think they both fall under 1st degree.
