Wow. Nel hasn't got copies of something to give rest of court...now reading OP's whisper/soft manner statement.

O: I'm not steering away from a whisper-it was put to me she wouldn't have heard a whisper, so I said it was a low tone...

ETA: I'm surprised OP said that, but I think he did...

I get the LED line of questioning a little bit (i.e., why the one LED light on the amp would bother him when didn't bother to cover other LED lights) however I get TOTALLY lost with the jeans getting thrown over the amp to cover the light and eventually end up on the floor on top of the duvet cover (per the photo) and Oscar's insistence that the jeans were NOT on top of the duvet.

I just don't understand what is even being implied. It's driving me crazy what the big deal is I am missing.

This all lhas to do with when in his affidavits he needs to see her and when he needs not to be able to see her.

I actually had all this in my satirical piece, "Let there be light' I posted a few days ago. Did you read that?

Nel: If someone said that line they were lying?

P: That’s right.

Nel: I know who said this… it was you.
P: If I said that it was a mistake.

Nel: That is your evidence in chief.
P: I said I remember it was a 'low tone' in which I spoke to her.

If the jeans are on top of the duvet, then Oscar's version of his last recollection of the duvet being on Reeva's legs is not true. If the duvet was on the floor when he covered the LED light with the jeans, then he can't claim he didn't know Reeva was not in bed.

N: Why don't you follow?...Friday you were very strong you definitely did not whisper. Now when it's pointed out your evidence in chief said you whispered, you say it was a mistake.

O: It's the first time I saw that...I don't see how that's tailoring my evidence.

Well, one thing's for sure - Roux has definitely not consulted with OP while he's been testifying

Agreed. Philip deWet wrote last week if Oscar had consulted with his attorneys, he'd have a broken nose now. ;)

Onto talking to Reeva.

N: She never asked where are you going, why are you getting up?...why wouldn't she ask?

O: No...I don't know why she didn't.

OP won't say what he would expect a person to do in that situation normally. Nel says he is too concerned with implications, O insists he just can't say what someone 'would' do and he doesn't understand the question.

Lord have mercy. I'm gonna let go of the notion that there is some big smoking gun with those jeans laying on top of the corner of the duvet. At least until Nel pulls some big rabbit out of his hat that he's been holding on to.

Yes, I think it's just undermining as many little things as he can in OP's version - with the hope that the cumulative effect will be to discredit his entire account. I don't think there will be any big smoking guns.

If you look at where the duvet is on the floor, it would not be possible for OP to be running back and forth to the balcony as he claimed to be that night. OP has been insistent that the duvet was on the bed and even agreed that the duvet being on the floor is a problem for his version. He says the police put it there.

So now jump to the LED light. Oscar claims after he placed the fans in the room that he went over to the amp to cover the light. In my opinion, this gives Reeva more time to get up to go to the bathroom and OP not to see her. Oscar says that he started to put the jeans on the light, but then heard the noise so he placed the jeans back down on the floor.

If the jeans are on top of the duvet, the duvet was on the ground.

Nel showing that there was blood spatter on that duvet, and also on the carpet in the same spot, I believe, proves that the duvet was on the ground.

OP is giving a long explanation but I couldn't follow the logic of it.

O: The first noise I heard was from the bedroom....I didn't have any doubt....it was the window hitting the frame. It was clear.

Jeez, he's not just tailoring his whispering evidence, he's trying to cover all bases by saying "I think I spoke to her in a low tone".

Exactly. The truth does not need to think ahead of the implications and change to suit , the truth is the truth !

OP says if Reeva had heard it she would have been as scared as he was and would not have said anything, she'd have got down and called police like he asked.

O: I didn't ask her is she heard it.

Nel is flogging a dead horse with the speaking to each other element. I get up and don't tell my OH I am going to the loo or going downstairs to make a drink. I just get up quietly and do whatever.
