Now onto bail affi. Nel reads and OP doesn't mention it. OP says he doesn't know why.

O: I noticed there was noone in bthrm, the toilet door was closed...there were many many thoughts going thru my mind; someone might climb in window, stick a firearm thru...

N: But did you think there was someone in the toilet?

O: Yes I did Milady.

So he wants us to believe an intruder broke into his house to use the toilet?

They are talking a lot about the toilet door slam; Nel thinks he did not say it in the morning at the right time in his version. Pistorius disagrees. (I thought I heard his say door very briefly…??)

Pistorius is unsure why it’s not in the BAS. I mentioned it to my legal team so I am not sure why it’s not in there. Even more devastating it’s not in your plea explanation.

He repeats, “I am not sure.” Quite a few times. Repeats this phrase.

Nel: I put it to you that you never said it to counsel.
Why did they not put it in?

Pistoirus again repeats: I am not sure Milady.

Nel wants to illustrate he’s tailoring his evidence constantly.

Pistorious blames his legal team again, but it’s presumably normal practice they would have put such a big detail in either statement.

He is saying he didn't extend his arm .. and this is on his prosthesis .. then the trajectory of the bullets, and the height of the bullet holes is going to be all wrong!

Nel wants that put on record, and insists: 'Were you aiming?'

O: I pointed my gun at the door...I didn't aim at the door. My firearm was pointed at the door.

OP denying that he wanted to shoot the person in the WC. He "fired at the door," not at the attacker.

Here come the tears again! I wish that he would just confess. Listening to Mr. Nel slice him to pieces is painful.

Apart from crouching, was it also said arm tucked into his side? Did someone say that was said about his arm?

Ah! This was when OP was moving along the corridor to the bathroom. He raised his arm and pointed at the door at the end of the corridor looking at the toilet door.

Nel asks again. OP says No, so Nel asks; 'What is your defence?'

I think the answer was fear???

I don't think he expected the crime scene investigators to be quite so good at what they do and be able to pick up on every little thing .. he thought/thinks he would/will be able to outwit everyone all the time, but hasn't realised how experienced these people and no amount of contamination will hide things like a trail of blood which follows a line across the carpet then onto the duvet .. and then which means, together with the fact the jeans are overlapping the duvet, that the duvet must've been on the floor all the time .. which then in turn means that the fan couldn't have been in the place where the duvet is.

Ne says he is changing defence from putative self defence. OP says he doesn't understand the law.

I know I am not crazy but didn't we hear Nel asking these same questions in depth last week? I know the one able the door slamming was because I got so frustrated how long it was drug out.



I guess SA doesn't have the objection "asked and answered" LOL!

Roux could object and Masipa could reign Nel in - as happened with Roux on cross. But its doubtful, imo, she'd intervene while Nel's questions are still eliciting different answers.
