Nel: We argue that the accus was on his stumps when Reeva was shot.....it was never put to mrs VM that she was mistaken when she said she heard someone arguing....

We say the bathroom light was on

The accused went downstairs and spoke to Mr B. He said everything was fine...we don't have, "Can you help me security."

I didn't think that was in dispute. Not in my mind anyway

But OP says gun went off without intention, then that means he didn't aim, imo. There was no control, OP wants it both ways.

  • #143
OP said to Baba "I am fine", Baba said OP said "Everything is fine". We never have OP saying "Security, security, help me. Can you help me Can you phone the police". We don't have that.

Yes!!!!

It was in dispute during the version of Oscar saying words to the effect of "the gun just went off and somehow four shots were fired". Sorry but I cannot remember his exact wording.

Nel says OP was an appalling witness. We argue he was vague and argumentative. He recalls details the detail on the highway but not who collected him. Nel says that's why he laughed, and he apologises again. The State says that cannot be seen as anything but untruthful.

I forgot. :(

:grouphug: It hasn't been the same without ya! I made breakfast for everyone.... a good southern one. Have a seat... we saved you one in the front row!

Well at least that's settled. State accepts it could have been "I'm fine" as per PB's 1st statement not "Everything's fine", as per PB's 2nd statement. as I thought I doubt it for the part of the State's case or the judgement after all the rivers of ink.

Nel: The accused's version - objective facts form a gruesome mosiac of events.....the accused was an appaling witness; vague, argumentative; his mendacity was so striking...

Nel goes on to recollect how he had to apologise for laughing when OP couldn't remember who picked him up in car park.

  • #149
Nel: OP more concerned about implications of his answers than the truth. Prof Derman displayed similar tendencies.

I have a feeling Nel is not going to address the order of gunshots/batshots and the seeming contradiction between the State's case and its witnesses.

  • #151
The State called the first policeman on the scene, the photographer. The State cannot be blamed for not calling other witnesses. It was never put to Van Resnburg that the fan or duvet had been moved.

Nel: as far as tampering was concerned, we had the defence question the movement of the bat. Nothing in the bedroom. BB

Nel: if the court accepts that the scene in Pic 55 is is true - the court will have no option to reject his evidence. BB

  • #153
Nel: Most devastating aspect, he's unable to contest photographic evidence of scene, prove tampering..

Mentions the number of defence witnesses defence failed to call. But, they did call 'the first police witness on the scene."

Says state can't be blamed for not calling witnesses. " As far as tampering's concerned, all we
have is bat moved a cm or so, if that.....there's no tampering."

Nel discussing if court accepts Mrs. Stipp's statement that bathroom light was on. Plus the testimony that Reeva had eaten within 2 hours of death. Both ruin OP's version of events.

I have a feeling Nel is not going to address the order of gunshots/batshots and the seeming contradiction between the State's case and its witnesses.

Then we'll have two "smudged canvases" !

  • #157
If the court accepts that picture 55 is an accurate reflection of the scene on the morning then it must reject the accused's version.

So very true.

  • #158
Lol..

Nel: (Accused's version) It cannot be...

  • #159
I forgot. :(

So glad you made it Zwie!
:happydance: It wasn't the same without ya. ATL brought a yummy good ol' southern breakfast. Make your plate and sit in front with us. I believe ATL saved you a seat.

Nel's on a role now. How clever the police were to move the fans, duvet and jeans not knowing what OP's version was going to be.
