I'm watching the memory witness from today---I think the DA missed a great opportunity when the witness elaborated on how if there is more time there would have been more exposures to cues to trigger memory. The witness was basically trying to excuse Ross's memory loss because it WAS such a short drive, a longer drive might've had a memory trigger due to the longer duration of the drive. If I were Boring I would've said, "so time would improve the odds of memory trigger? You mean like the SEVEN hours Cooper sat in the car? Somewhere in the course of those 7 hours something like seeing his picture, sending a text message complaining about his son, going back to the car to throw in lightbulbs, texting his wife about when she was going to pick the kid up, the alleged phone conversation with the wife about picking up Cooper, co-workers asking about Cooper, etc. etc" could've resulted in a memory trigger? Great point witness." Instead Boring said, let's just move on because there is no definitive answer...

LOL. You didn't burst my bubble. I take it you didn't watch the testimony today?

Ohhh My..Yessiree..The witness (only one BTW~~) came across as totally ignorant of the testimony of this case..and actually appeared to be taken aback by facts Boring pointed out.. The Bubble I speak to is that supporters of "Forgetful Ross" continually forget..those Other cases hold absolutely No resemblance to Ross's history ( 6+ years history) fits into his nor Dr.Diamonds. data and previous past cases Dr. D. has testified to. Why is it..DT now has only estimated half day DT witnesses left..Thought Dr. D> was their PRIZE Witness that would explain away what RH did???/

Ain't going to happen..WHY?? Because Dr. D. has "Principles" which he will not cross...Too bad so sad..Ross Harris just does NOT fit the profile for being a forgetful parent..Get use to it :drumroll:

That's what makes me wonder about Diamond. It will take an hour to go through his CV! Then direct, cross, redirect, 50 slides?
Done by noon?
Maybe...
I really thought this trial would drag out until turkey day....what's the next big trial to anticipate...

I completely agree with you. This witness looked repeatedly stunned and gave visual cues that he was actually starting to disbelieve this theory on Ross (nodding his head, grimaces, facial expressions). Obviously, I have no proof, but methinks that if someone randomly approached this guy 2 months from now and asked him if that theory still flies---I bet he would say "no comment."

I felt the prosecution definitely, definitely had the upper hand on this. The defense was surely reeling.

Totally agree...how in the world can anyone think this went well for the defense today? I guarantee Kilgore knew it was a total bust....Boring made his look as if Brewer was there for the state...it was so bad I actually felt sorry for the young man...got way more than he bargained for!!

IIRC he got the witness to agree all of those things could have triggered the memory

I think that CB's best moment of the case came this morning. It was extremely compelling when CB rattled off 10ish triggers and the witness kept agreeing that each item was in fact a trigger. I was really struck by the number of triggers that occurred before Ross got out of his car at 9:27.xx in the morning.

I agree with you that CB missed the opportunity that you stated above, but I think that the point was still made during cross.

He was quite pleasant, I feel sorry for him as well. But I don't think his performance was a reflection on him, rather...a reflection on the defense. Does anyone know why McRea is supposedly not testifying anymore??

I wonder if the jury will understand why Ross can't testify about forgetting Cooper without possibly incriminating himself on the other charges. I know that if I had accidentally left my child in the car, I would want to get up there and let everybody know that I didn't do it on purpose. But with the charges not being severed has made that impossible...But, on the other hand, I guess the sexting was such an integral part of the state's case against RH that they couldn't be severed...kinda a catch 22 for him and the DT. It's just so obvious that he is guilty of the sexting that I think I would just get up there and be honest about it and let people know that leaving Cooper in the car was a tragic mistake and take whatever consequences for the other charges...just so people would not think I had purposefully murdered my child...That is, of course, if it truly WAS a mistake.

No way should he testify imo... He's a liar, he makes ridiculous exaggerations and he fakes emotion. Put him on the stand and the jurors aren't going to believe anything he says anyway, and he will just make himself look guilty with his exaggerations and faked/ forced emotion. :moo:

I think he did that because the witness was being a dolt and couldn't understand boring question or rather didn't want to answer so he put it aside and approached differently a few minutes later instead of rephrasing right then and there. It was effective imo

Could the State have been more RUDE during this testimony on direct?! Rolling eyeballs, looking at watch, tapping pen, openly displaying contempt, looking over to the jury with "can you BELIEVE this?" expressions..

If this jury is paying attention, they know this is important, even crucial testimony they're going to need to fairly deliberate. I hope they are offended by this kind of disrespectful arrogance- I know I am.

Boring must have issues with his tie too, he kept messing with it, he fidgets a lot when he gets excited. And his condescending... RIGGGGHHHHTT!

It's not just the state! Kilgore (whom I like, BTW), always sits looking bored and looks at his watch CONSTANTLY. I'm sitting there attentively hanging on every word, and he's kicked back with his lips poked out, playing with his watch.

It appears to be a Rolex, and he only looks at it for an instant, but does it repetitively.
