  • Slide shows a hammer's claw the fits in to a damaged portion of the skull.

Now from this I'd think you'd be able to tell where the person was standing in relation to Tori and possibly whether the person was left or right handed. Let's hope so anyway.

Pollanen tells jury there are many different kinds of hammer that could have made the same impact damage.

Pollanen says a second impact site on top of head had a round profile.

Next slide shows impact site D, which appears to match up with the other side of the hammer.

Pollanen says there were four hammer blows to head that resulted in skull damage, may have been others.

Pollanen says he can't offer an explanation for the facial fractures. Can't say if they are the result of hammer blows.

He can't exclude or conclude a hammer blow caused the facial fractures. Can only conclude four hammer blows to the top of the skull.

All I have to say is, I've seen facial injuries to a child's skull and the person who did it killed her and raped her too: it was Christine Jessop's case. JMO

And an innocent man was charged and sentenced for that rape and murder as well.

the farmer also added to that rock pile a couple of times so we don't really know how many rocks they had thrown on her...

I'm unsure how far away the remains were from the rock pile, but wondered right from the beginning if some of those rocks could have rolled down from the pile onto it. Initially, it occurred to me that disturbing the pile when they allegedly removed some might have been responsible for a mini-rock slide. Now that we know that more rocks were added to the pile, it seems even more feasible that some of them (especially the really heavy ones) could have slid down on top of the body. I just couldn't see either of them lifting 100+ pound rocks when there were smaller ones. Forgive the pun, but it sounded like overkill.

I thought TLM testified they put rocks on her body. I don't think she specified a number.

Why didn't the testimony include whether Tori's remains were found prone or supine? If she was supine, the rocks could have caused the facial injuries. Otherwise (prone), it had to have been either the hammer or the kicks she suffered beforehand.

Beforehand, Ontario Superior Court Justice Thomas Heeney told jurors to brace themselves, saying what they were about to see “cannot help but tug at your heartstrings,” but said they had to decide the case without emotion.

“We are, after all, dealing with the death of a little girl,” Heeney said.

“You’ve been warned about graphic images being shown before and they’ve no doubt been disturbing, but I can tell you that this will be the worst that you will see during the course of this case, so you really need to steel yourselves.”

Dr. Michael Pollanen, Ontario’s chief forensic pathologist who performed the post-mortem on Tori, also warned jurors, saying such images are “confronting” even for pathologists.

“The body is going to be in a state of decomposition,” Pollanen said. “So, while you will recognize some of the body you might not recognize all of it.”

By the time Tori’s remains were found by a police officer more than three months after she disappeared, they had deteriorated to the point where no evidence of sexual assault could be found, court heard.
