It’s no secret that I believe decision trees can make a difference as you try to settle your next lawsuit, and my series on decision trees will tell you why. But I’m not the only one. Your comments to my prior posts, our follow-on discussions since then, and a little research confirm that a confident minority of mediators and litigators use them, too

deal?????????????

RaffertyLFP: Heeney said the jury can consider reducing the first degree charge of murder to 2nd degree or manslaughter [via Twitter]

NOOOOOOOOOOOOOOOOOOOOOO!!!!!!!!!!!!!!!!

Yes - but why would they? It would be 1st degree murder or "not guilty" in this particular case (in my opinion). So dont worry!

AM980_Court Jurors may find Rafferty guilty of second degree murder or manslaughter if the crown hasn't fully proven first degree murder.

I really don't understand how this is possible?

If he knew at any point that Victoria was being held against her will then he is guilty of kidnapping. And his lawyer pretty much suggested that he did know when he suggested that Victoria was offered up as a sexual gift to him, and that after that he was directed to a rural area. And instead of calling the police right then and there he did drive to the rural area. I believe he also suggested that Victoria was being held for a drug debt and something about a safe house? All suggestions from his client?

Now none of this can be considered evidence but it was a strange thing to suggest if you want this jury to believe that MR had no idea that they weren't just driving Victoria to some friend's place in Mt Forest on behalf of her parents. Maybe he should have tried that one.

MOO

Excellent point ... if he thought Victoria was taken as part of a drug debt, he knew TLM wasn't babysitting ... knew it was a kidnapping, the kidnapping resulted in murder ... therefore: guilty.

Showing the decision tree. A variety of statements with yes or no answers. Then arrows directing to a new box depending on the answer.

RaffertyLFP: Heeney said the accused must have applied deadly force and have meant to kill the victim to trigger a first degree conviction

actually I tend to think that the closing argument was much more in his face.. like all of it all together: the totality of the evidence (and tended to shine a light on the lack of a defense that his lawyer put up for him imhoo)

as for all the facial pulls he was exhibiting.. well... I watched Casey Anthony do it for months! I don't think it is that odd.... but I do think it is very disturbing (my opinion of course)

I agree. The end is near and I am sure it was anxiety on his part.

Would he feel the same if the child was made to sit on the floor, under his coat? And asked to drive them to a fairly secluded location?

ETA: I'm also assuming that your husband doesn't sleep with 18 year old drug addicts.

bbm JMO the "wild card" here is how much, and what parts, of TLM's statements will the jurors believe. We'll know soon. JMO

Only TLM testimony to say VS was on the floor and under the coat ... just saying.

Second comment was not necessary unless you are trying to stir up a negative reaction ... just saying MOO

I was trying to point out that it sounded like you didn't give him all of the information. The 2nd comment was to point out that he would never be in that situation.

It was in testimony (they met at the pizza place). No need for the judge to remind the jury or recap how they met, imo

This is useless. Get to the charges already!

I'm curious ... why are you impatient about the legal process?

  • #352
I think all that means is the judge is recapping, and mentioned the "stream of ex-girlfriends". He didn't actually "recap" them all. If he did, he'd still be talking about them.

Somebody tweeting about the case used the word "re-cap", but that isn't what the judge is doing.

Yes, but the crown presented it as a sexual motive and dismissed the drug debt theory ... so from what I understand can use drug debt theory to determine guilty. (No evidence presented of drug debt)

The 'decision tree' helps jury consider manslaughter, 2nd deg. and 1st deg. murder. All three are involved in 1st deg. judge says

The judge is taking the jury through a 'decision tree' that will help them make a decision

The first decision jurors must make is who hit Tori with a hammer. Many decisions follow.

RaffertyLFP: Heeney says manslaughter not option for jury if they decide Rafferty is principal killer - only available if he is an "aider and abettor

I think they're were trying to ban brothels and it didn't happen. My city has started talks of allowing the escort agencies to open some here. Prostitution on the streets is illegal still. Brothels are a business providing a service, and also provide some protection for the "staff".

It's all the same to me.

casinos, brothels, rampant drug use; society is in decay. IMO

I'll take a guess at that and say that we've been waiting 3 years for a verdict and just want to see justice. ASAP.
