In my opinion TLM has nothing to lose at this point by admitting that he specifically picked out Tori - I have never believed that she was targeted. I truly believe it was random that Tori was chosen and had she not gone back in for her moms butterfly earrings, either another little girl would have been taken, or they would have postponed it...

As for the dog -- per her, Rafferty told her to talk to the kid about puppies (all kids like puppies) and TLM's dog just happened to be the same as Tori's...why would she mention some other breed?

I don't think there was a connection, except the brief meetings described by TLM, between Tara and TLM - or Tori for that matter.

I agree with you that TS wasn't targeted. However, I think the whole thing was planned in advance or at least was thought about it alot. MR remained way too coolheaded after the murder, he knew exactly what he should get rid of, he doesn't act irrational as I think most impulse murderers would, etc. JMO

If DNA of the perpetrator was still available then I would think so.

I mean just physically? She was after all a child of 8, she wouldn't have had experience sexually, wouldn't there be signs other than DNA? This is delicate, I mean wouldn't they know if she had been abused just by looking at her pelvis or something?

I would hope they can HK.

I do hope so, because TLM told so many lies, she was so high the night all this happened, she could be mis-remembering things or leaving stuff out, or confused about stuff(i'm sure defence will pounce on that)P. It would be devastating if MR was proven not to have been there. Altho, she appears to be very consistent about what MR was wearing, or rather what he wasn't wearing (his pants, shirt) after the murder. A guest lawyer on the news last night said that's what the defence will be attacking, how consistent she is with her info. He said that if she remains consistent and doesn't change her story from her confession, then they should be good.

I don't think Tori was targeted specifically but it appears he thought of things ahead of time. While the abduction/murder wasn't completely spontaneous, he still wasn't too bright about things (criminally speaking). Remember, this is a guy who put his faith in an 18 yr old junkie who he met at a pizza shop two months prior to committing a crime of this magnitude. Not the sharpest tool in the shed. JMO

Are they legally allowed to use wire tapping in the jail as evidence? I heard that they cant because its entrapment.

Agreed. He really did some rookie stuff. As for trusting an 18yr old junkie, I think she was the perfect tool. I think that's why he picked her specifically. I wonder who he was talking to on his blackberry when TLM showed up at the pizza place and he said in the phone 'what a cute little number' or whatever it was he said.

The inmates know they are being recorded so it is not the same as "wiretapping" which is a covert operation tool. One case i can think of is the Tom Svekla trial in Alberta a couple of years ago.

ETA: Caveat ... I jumped the gun on this and will have to check my facts on it being "evidence" .. I could be misremembering and maybe the Svekla recordings were released after his trial was over. Sorry, but will try to find out.

In the US, prisoners have NO expectation of privacy. Calls and visits are almost always recorded and can and often are, used against the prisoner or the visitor.

#Rafferty - judge clarifying to jury what a lie is - repeating it does not make it true.

Sounds like this creep was just starting a career.

Or was he taking it to the next perverse level. JMO he has done other crimes similar in nature and wasn't caught.
