I wonder how long TLM will live in prison now that she claims she killed Tori with a hammer and would kill again? In my opinion, she wants to die in prison but not of natural causes. JMO

How does Derstine know this? What exactly is going on here?

Wearing a grey sweater and black and white top and sporting glasses, McClintic admitted on the stand that she recently had told her godmother during a prison visit that she felt no remorse for killing the young girl.


"That you were only sad about the killing . . . that it was a little kid. Otherwise you could it again?" pressed Derstine.


After a lengthy pause, McClintic replied "Yes"

He could be lying about her to explain his knowledge of the case. OR it's true and I have to wonder if she lives in the house that he knew the layout of that was right next to Oliver Stephen School. JMO

If Derstine is admitting and placing MTR at the scene, then there must be forensics to indicate as such. No getting around that (no pathetic history to attack).

Derstine is placing MTR at the crime scene. IMO LE has forensics that cannot be disputed. The Defence has no choice but to admit that he was there.

I guess he is suggesting that MTR was "zipping around" in his car, or some other alibi, while TLM was alone in the field with Tori. Probably drove around to clear his mind, or absorb the drugs or whatever. Then went back and lo and behold TLM had murdered Tori, so he helped her clean up, and then they went to clean his car out etc.

What can you say to this offering by the Defence? I don't know how Victoria's family is coping with this.

Mr. Derstine suggested Ms. McClintic then “offered” Tori to Mr. Rafferty, which he rejected. So, Ms. McClintic told Mr. Rafferty to drive north, purportedly to reach a safe house.

When they arrived at the side of a country road, Mr. Derstine said, Ms. McClintic told Mr. Rafferty the child was scared of him and she needed to talk to Tori alone.

While Mr. Rafferty walked away, Ms. McClintic killed the girl, he said.

“When he returned, Mr. Rafferty was horrified but helped you clean up,” Mr. Derstine said.

Police didn't find the car through the holiday weekend even thought they had his plate number and saw it at his moms'. Where was it? JMO

I find it very interesting that he was seeing "Amanda" who's daughter was friends with Tori. I also find it interesting that his lawyer didn't really even touch on the subject of the sexual assault or try to say Rafferty wasn't at the scene.:moo: I also found it interesting that his Mom walked in when he was talking to LE and she just said "hi" and left????

I have to say, that I am just devasted at what poor Victoria went through, regardless of which version, the sweet, innocent child spent her last hours with these people, and for that I am deeply sorry. :(

Well, for me, this is a smaller town and I can see everyone may know everyone else... It could be a coincidence that Amanda's daughter knew Tori..... just a thought. Also, perhaps MR's mother was in shock and just kept going.... speaking to him later about who he was chatting with? Again, not protecting this family, just trying to think logically.... I could be all wrong! LOL

Finally, a reporter looked into the legal precedent regarding the original videotape confession. It's called a "K.G.B." application.

Some info here:

The video excerpt was ruled admissible as "substantive evidence" by Ontario Superior Court Judge Thomas Heeney after prosecutors successfully made what's called a "K.G.B." application.


The letters refer to the initials of a youth who was acquitted of stabbing to death a man after the witnesses against him, his friends, at trial recanted the incriminating statements they first had given police.


Because the common law rule then was that such statements, if recanted, were hearsay and couldn't be used as evidence, the trial judge (who found the witnesses had lied to him) with great reluctance acquitted K.G.B., a decision upheld at the Ontario Court of Appeal.


But in 1993, the Supreme Court of Canada on a Crown appeal ordered a new trial and agreed the old rule should be changed. Now, so long as a judge finds they are necessary and reliable, such "prior inconsistent statements" are evidence as good, or bad, as testimony given in court.


Heeney told the jurors just that on Wednesday, before they watched the videotape of McClintic's confession: They can accept everything she said in that interview, some of it, or none of it, just "as you may with her oral testimony."

Were the detectives in uniform? If I saw my son with cops, I'd be questioning what the heck was going on. Maybe it wasn't his first run in with authorities (??) :waitasec:

If that scenerio was true how would he explain having to cut out the back seat or getting rid of it. Would be no need.
