That has happened. I had customers calling to change their cell number because they were getting too many text messages from contacts of the person who had owned the phone previously :)
 
They were already onto him and he knew it. It was just a matter of time. IMO

Showing Brady a letter sent from Bell. Letter says a replacement order was created for Rafferty's blackberry on May 14th.

Document says Rafferty got his new blackberry at Masonville Mall on May 20th. It's a typo, Brady says. It was May 19th.

So MR complained to Bell about his phone not working properly on May 14th, yet his first interview with police wasn't until May 15th. So it doesn't seem to me that he exchanged his phone because he was spooked by the police.

from the second his alleged accomplice (tlm) was nabbed he had to know that his time was short (thusly complains loudly about phone so there is a witness than switches it out)

If he had a guilty conscience, he may still have wanted to get rid of it with the hopes LE wouldn't be able to trace anything if they did catch up to him.

So if we have one more chapter after this does D-fence get to start their case after the crown is done? As well is the crown able to cross examine D-fences witnesses

Mike Knoll: @bob - keep in mind that things can change - especially since the Crown laid this out at the start of March, but once again, here are the chapters from the Crown's opening:

Chapter 1: The day of the kidnapping. The surveillance video showing Rafferty driving up the street outside Tori's school and McClintic walking Tori up the street. Witnesses from and around Oliver Stephens public school will talk about seeing Tori.

An identification officer will use photographs and maps to show the route from Woodstock to Guelph.

Tori's mother, Tara McDonald, will testify about the frantic hours the family spent looking for Tori.

Chapter 2: Terri-Lynne McClintic. "She was an essential part of all that happened," Gowdey said. "I expect her credibility will be a major issue in this case."

Chapter 3: Guelph -- video surveillance and bank records detailing the events there.

Chapter 4: the Mount Forest death scene, which the jury will visit. "It will be difficult to go to the very place where this happened, I know that, but understanding the crime scene is crucial to understanding the crime," Gowdey said. Photographs, some of them graphic, will be used to explain "exactly how the killing happened."

"Unfortunately it is only through them that you can fully understand (the) evidence," Gowdey said.

Chapter 5: Police interaction with Rafferty.

Chapter 6: The searches of Rafferty and McClintic's residences and the evidence found.

Chapter 7: The Honda Civic. What was found inside.

Chapter 8: Rafferty's connection to the Mount Forest area.

Chapter 9: Comments Rafferty made to friends after April 8. "He had some interesting things to say to other people about Terri-Lynne McClintic and about the kidnapping itself," Gowdey said.

Chapter 10: The May 15 weekend and Rafferty's actions.

Chapter 11: The BlackBerry. The BlackBerry allowed police to track his movements April 8 and after.

Chapter 12: A recap of the surveillance video.

That's when he got the new phone, IIRC The same day he got arrested but I'll have to read back on the tweets.
 
Yup.....this judge has done a few things that I'm not very pleased about but I'll reserve my comments backed up with facts until after the trial.

Well, I won't.

That comment struck me as very insensitive. We're talking about justice for an 8 year old girl who was brutally murdered. But yeah, you go ahead and have your nap.

I don't think the fact he returned it means much, if he had known enough to take the battery out before leaving Woodstock, like TLM said, then he'd know that incriminating evidence would be on the phone whether he returned it or not.

LOL I laughed a that one too. Whenever they talk about him saying he was a dance instructor, I think of him having two left feet when it comes to actually dancing. Then I think of Eugene Levy in that movie, Best in Show, his character actually had two left feet!

Hahaha I am going to have that vision in my head now too.
 
I personally felt this testimony was making my heart race awaiting who those phone calls were to and from prior and day of Toris abduction.

Perhaps that's why he was planning to go to the states, he was getting ready to flee. And perhaps that's why he had so much money in his car, and perhaps that's why that when he was arrested the media reported that his girlfriend was trying to help him flee the area (I assumed they meant TLM) but they could have meant JW (I know she didn't) but at that point media didn't have the whole story.

Dang it, I freaking have to go and I don't know if I can stay tuned on my iPhone. Grrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrr. I'm tired of all these breaks too, I know it's a part of the process, but it buuuuuuuuuuuuuuuuuuuuuugs me! :)

If Rafferty got the original phone in 2007, does that area code make sense to where he lived? I'm confused. Isn't his area code 519 ?

Why would he have a 905 area code?
 
He had requested GPS on his phone when he bought it in 2007, he obviously knew the phone could be tracked. So, he takes the battery out before leaving Woodstock, then puts it back in at some point, checks his voice mail, lets TLM use it to make phone calls, all the while knowing the phone was GPS enabled.

Then, he waits more than a month to return it? (and waits a month after TLM was arrested)

It sounds like MR's phone wasn't working, so Bell sent it to RIM to try to fix it. They couldn't so they replaced it.

Nothing much unusual from similar events that happen thousands of times a day in cellphone booths across Canada.

I would think the phone records haven't revealed anything of interest yet.........when characterized as "sleep inducing" by the Judge.

Just from the events of today, It could be that Judge Heeney wants the Crown to move ahead with it's case.

If I was to go to court, I could produce enough character witnesses to tie up the courtroom for the next 2 years........but it be repetitive and non productive.

Sometimes the Judge has to step in and move things along.
