RaffertyLFP: Derstine says one entry says repeatedly "i don't know Tori Stafford" so she won't forget

McClintic repeatedly said she didn't know Tori Stafford in her notebook.

Derstine says he has never met Justin Bieber, but doesn't need notes to remind himself if that.

and so did MTR say he didn't know TS; guess they stuck to the story. MOO

Why would Rafferty need tools, he asks. Says McClintic would. Does anybody not know Home Depots have cameras, he asks.

RaffertyLFP: Derstine says the Mount Forest scene does not reinforce McClintic's credibility

Derstine asks: didn't they know that Home Depot has security cameras? #Rafferty was a full grown man, didn't need hammer to kill Tori

NEither would TLM. MOO

Avery Moore ‏ @AveryFreeFMNews
Derstine argues w/ 326 students "Isn’t it remarkable that the person [McC] stumbles across is the person she is connected to?"

Did we get all of Carol's "customers" on the stand to find out if any of them had children in that school? I guess not. Not like I figured any of them would have come forward or anything.

RaffertyLFP Derstine says Rafferty already knew he had tools in car including a hammer McClintic would not know that

As McClintic waited in the car while Rafferty got cash at Petro Canada, she could have seen the Home Depot and decided she needed something.

The crown will try to establish silo and positioning evidence during their closing. Derstine suggests she could have seen silos elsewhere

RaffertyLFP: Derstine says the real question is Rafferty's intent "What did he think and when did he think it"

affertyLFP Derstine says the Mount Forest scene does not reinforce McClintic's credibility

The question of "Who Hit Tori Stafford with a Hammer?" will have a clear answer, he says.

RaffertyLFP: Destine says credibility of McClintic is central to the case "You should have an extremely hard time believing anything she says"

So why believe she killed Victoria then?

MOO

"The real central question here is who was the actual aggressor here? Not who saw what silo where."

Derstine suggests scene evidence is not helpful.

RaffertyLFP: Derstine said Rafferty's connection to Mt Forest is not relevant - so what? Why would he drive all the way - lots of rural areas around

Nobody disputes McClintic played a part in the clean up. Witnesses called said Rafferty knew Mount Forest area.

"So what?" Derstine says. He suggests if Rafferty knew he was committing a crime, he wouldn't have driven so far

Other rural areas were much closer to Woodstock, he says.

He will end up serving time period ( i cant see it any other way ) but I do not want his TRUE crimes to go unpunished nor do i want him to be charged with something he did not possibly do.

We're far from a verdict and sentencing at this point, but what if the judge instructs the jury to not find him guilty of murder, but just indignity to a dead body? There is a case before the court in Woodstock right now where a man is accused of a murder his girlfriend has already pleaded as accessory to and is now out and he's only pleading guilty of indignity, yet he allegedly did the killing.

Derstine's defence would be far more credible if he'd pleaded Rafferty for indignity to a dead body.

RaffertyLFP: Derstine says why would grown man need to tools to kill little girl? He already had a knife in the car

Rafferty said, according to McClintic, it would be "too heat" to use Armstrong's tools. Had to head to Home Depot.

Assuming Rafferty did need tools, he a,ready had a knife in his car. Why would a full grown man need a hammer, he asks?

It was an exacto knife Derstine. Kinda hard to use as a murder weapon.

Derstine says #Rafferty's connection to Mount Forest doesn't offer Jury much in this case

Steven D'Souza ‏ @cbcsteve
Derstine says Mt. Forest scene doesn't prove McClintic right. Says real question is who is real aggressor, not who saw what Silo #sl

AM980_Court Forensic evidence tells you "less than you might imagine".

RaffertyLFP: Derstine said Rafferty's connection to Mt Forest is not relevant - so what? Why would he drive all the way - lots of rural areas around

TLM couldn't even re find a Tim Horton's in Guelph. Or a car wash in Cambridge. So we are to believe that she found that rural lane the first time no problem? His connection to an jobsite 5 miles away though is not relevant?

MOO

Pollanen says Tori was savagely beaten and hit with a hammer. Crown may suggest there were four blows, not three like McClintic said.
