Derstine said it was a bloody scene. Gowdey disagrees. Notes Pollanen's evidence.

Gowdey notes the medical evidence is silent on sexual assault. But says that's because the two of them buried her in a clandestine grave.

Tori wasn't found for 103 days.

Almost all the things police were looking for were never found. Searched the scene, other areas.

No backpack, skirt, leotards, back pack. Never found the car seat, McClintic/Rafferty's clothing. Never found the hammer, Home Depot bag.

Together, the two destroyed much of the evidence in the case.

Gowdey says Raffetty drove 130 kilometers. The accused was driving his car. If it was McClintic's idea, why would he drive that way?

"Unless you are part of a two person team and you need a perfect place to commit your crime"

McClintic have her self up, what was in it for her to not lead police to the scene? She didn't know the area.

Her attention to detail is consistent with her being the bystander.

Gowdey says the evidence of the sex assault was Tori being found naked from the waist down.

McClintic says Tori grabbed her hand, she had to pee. Tori held on to her so she didn't fall. Rafferty was in the back seat.

McClintic said there was blood on the snow after Tori went to the washroom. She then walked her back to Rafferty.

McClintic left, she knew what was about to happen, again, to Tori.

McClintic said during the second sex assault, she was looking out into the field.

Gowdey says those details cant make McClintic look worse as a human being. "You do not make that up".

Gowdey says there's no basis for Derstine's suggestion that Tori was peeing when she was killed.

Unlike Rafferty, McClintic was not occupied with a sexual assault. She drew that detailed map.

The police didn't have anything, but McClintic gave them all the info they had in May 2009.

IMO... the video is what is showing this partnership at the HD / Petro...he took the cash out, he gave TLM the cash, he stayed in car with kidnapped Tori, he "popped" the trunk for TLM to put the bag in....

Its all on video, not just from TLM... The withdrawl shown on video and banking records, the video of TLM walking from MR car to HD, the purchase in HD of murder toosl shown on video, the video of MR pulling up and popping the trunk...

This is not just TLM's testimony.

And he parked and stayed away from the entrance. MOO.

All I can make of Rafferty's histrionics is that he's trying to "testify" to the jury that he's innocent. Well, he missed his chance to do that. He'll now have to tell it to his cellmates.

To a point. The claw end of a hammer not so sure a bag would stay sealed . JMO

I believe using the claw end of the hammer would have ripped the bags apart and caused terrible damage to the skin on the head, causing a lot of blood to spatter around.

The Crown is also assuming, by way of TLM testimony, that she had put the garbage bag over the head of TS.........before she started striking her.

I think it started in the back seat of the car, and that is why TS blood was found on the molding.

TLM left out that little detail about her killing TS.....probably because her "flashbacks" wouldn't as easily explained away her state of mind.

I've thought that all along too! I am glad Gowdey is pointing things out to the jury and not relying that they will make all connnections.
