VERDICT WATCH - NE - Sydney Loofe, 24, brutally murdered, Lincoln, 15 Nov 2017 *Aubrey Trail GUILTY* #4

10/13/20 Day 12 of Trial (Day 14 on twitter): The judge has informed the court the prosecution only has one more witness that may take an hour to finish. Says the jury will likely hear closing arguments around noon, so she believes the case will be sent around 1:30-2PM. Final State witness: FBI Special Agent Mike Maseth who was the lead investigator in this case. Questions are starting with Boswell’s pinger numbers & the date of their creation. The defense again objected to the first pieces of evidence being submitted. The evidence is data logs of phone calls Boswell made to Trail on Nov 14th. The objection, Agent Maseth does not have the expert knowledge that Investigator Hurley (who tracked RTT data) did when compiling phone data. The objection is sustained. Now questions are focused on what Trail & Boswell purchased the 15th & how many of those items were recovered from Trail & Boswell’s apartment. Notably missing was any Draino, a hacksaw, or tin snips, all of which were allegedly used during Sydney’s murder. Maseth walked the jury through a video of Trail & Boswell coming & going from a hotel near the Ameristar Casino on Nov. 18th. A trip the group made on Nov. 18th was discussed. The group was staying at the Ameristar Casino but took a trip south to Nebraska City. During this trip Boswell was called by an LPD investigator. Data shows Boswell missed 6 calls from LPD the 17th and 18th. The prosecution finished questions, cross exam for Maseth is started. And then re-direct. After a short bit of redirect Maseth finished testimony. A phone call was being submitted as the last piece of evidence. Maseth finished up witness testimony from the prosecution side, the defense will be up next after the phone call is submitted. The phone call was from LPD investigator Cameron Cleland to Boswell was played for the jurors. The prosecution & the state rested its case. The defense started with a motion to dismiss charges. Claims the state hasn’t proven anything regarding Boswell killing Loofe, just Trail. The defense has motioned for every charge to be dismissed. The objections are all focused on the state not proving these crimes. Some questions on venue are being brought up as well. All motions have been overruled. The defense rests its case without calling any witnesses or showing any evidence. The jury has chosen to hear the case starting tomorrow morning. This means we will have no verdict today, potentially tomorrow. Closing arguments by prosecutor Mike Guinan. The prosecution walked the jury through the timeline of this whole story. Closing arguments by defense. Trial continues to 10/14/20 with the jury starting deliberations.
*Aubrey C. Trail (51/now 53) – Found guilty of all charges 7/8/19. A 3-judge panel will hear penalty phase. 11/15/19: Judge denies Trail’s death penalty challenge. Judge denies motion for new trial. Aggravation & Mitigation hearings on 12/15 thru 12/18/20.

Oberhansley also said he wasn't guilty of the charges & that "I do feel horrible for what happened to Tammy * I do care about her," Oberhansley said.
