Trials & Sentencings for the week of Monday, Nov. 2nd thru Friday, Nov. 6th:
Monday, Nov. 2nd:
*Sentencing Hearing (@ am CT) - IN –
Ryan Allen Martin (29) (missing & found (in Jasper’s bedroom closet) May 23, 2019, Lafayette) - *Talmadge Russell Jasper (19/now 20) arrested (5/23/19) & preliminary charged (5/24/19) with murder, residential entry & invasion of privacy. Plead not guilty by reason of insanity. No bond.
Trial was set to begin on 2/25/20 continued to 9/22/20 & cancelled due to guilty plea.
5/30/19 Update: First appearance hearing held. Probable cause found. Formal pending charges read: Murder, Residential Entry break & enter dwelling (Felony 6) & Invasion of Privacy-Violates protective order (Misdemeanor). No plea entered. Held without bond. Next pretrial hearing on 9/27. Trial set for 10/22.
6/7/19 Update: Defense files motion for pre-trial discovery.
9/17/19: Notice of Intent To File Insanity Defense and Hearing To Determine Competence To Stand Trial on 9/27 at 8:30am. Jasper's attorney filed a request Tuesday (9/17/19) asking the court to appoint two psychiatrists to examine Jasper and determine whether he's competent to stand trial. The filing asked that the court receive reports from these psychiatrists, then set a hearing to determine whether Jasper should stand trial in his current state.
9/27/19 Update: Held. Trial for 10/22 has been cancelled. Next pretrial conference hearing on 1/31/20 & trial has been set for 2/25/20 @ 8:30am.
1/31/20 Update: Motion for trial continuance-granted. By agreement of counsel, trial scheduled for 2/25/20 has been cancelled & trial will be continued to Sept. 22, 2020 at 8:30 am with a pretrial hearing date of Aug. 26, 2020 at 8:30am.
8/26/20 Update: Jasper pleaded guilty to murder Wednesday for beating Ryan Martin to death inside Jasper's Pheasant Run apartment on May 23, 2019. The court will decide at sentencing whether Jasper is mentally ill, and prosecutors will dismiss charges of residential entry & invasion of privacy at sentencing. Jasper's guilty plea makes the insanity defense a moot issue, but his mental health could be an issue raised during his sentencing hearing. The plea agreement states that prosecutors will not contest Jasper's claims of being mentally ill. If Tippecanoe Superior 2 Judge Steve Meyer finds Jasper mentally ill, it will not affect the sentencing range of between 45 & 65 years in prison. It might affect Jasper's placement inside the Dept. of Corrections so that he can receive mental health treatment. Jasper's sentencing hearing is scheduled for Nov. 2.

Dylan Redwine's father’s trial in death of son, rescheduled to 18 September 2019
1029/20 Jury Selection Day 1 Thursday: A total of 19 potential jurors were in the courtroom. The judge was asking just general questions. Thursday’s jury selection was the first of several rounds of questioning to weed out people who don’t qualify or can’t serve. Right off the bat, five people were excused because they could not serve that much time, mostly for work-related reasons. Another person was excused after he said personal health reasons were a concern amid the COVID-19 pandemic. At the end of the brief hearing, potential jurors were handed a list of witnesses to look over to see if they had any relationship with people on the list. The jury pool will be called back at a later time. (Of the original 19 - 13 left to come back). Jury selection continues on 10/30/20.
10/30/20 Jury Selection Day 2 Friday: At Friday’s 8 a.m. session, Redwine’s public defender, John Moran, raised concerns about a document with background histories of potential jurors he was just provided by prosecutors with the 6th Judicial District Attorney’s Office. The document included “extremely private information” on 1,094 people who were called for jury duty, such as if the person had a history of child abuse, sex abuse, drug use or had previously attempted suicide. District Judge Jeffery Wilson, overseeing the case, ended the discussion Friday morning because it was happening in front of potential jurors. The court reconvened later, outside the presence of potential jurors, to take up the matter. Wilson called the whole matter a “big ado about next to nothing.” “We’re done for the day on this issue,” he said. “I just don’t see it being an issue.” Day 2 of jury selection is over. Jurors will report on Monday, 11/2, Tuesday, 11/3, Wednesday, 11/4 & Thursday, 11/5 will start the voir dire, with the 98 Jurors that they have left on 11/6/20. Audio will resume the afternoon of 11/5/20 at the conclusion of individual voir dire. Moran tried once again to delay, but Judge Jeffrey R. Wilson denied his request.
11/2/20 Jury Selection Day 3 Monday: No public/no cameras. Jury voir dire. Continues on 11/3/20. Audio will resume the afternoon of 11/5/20 at the conclusion of individual voir dire.

WA - Jody Loomis, 20, Mill Creek, raped/shot, 23 August 1972, *Arrest in 2019 DNA*
10/27/20 Trial Day 2 Tuesday: State witnesses: No info available yet. Trial continues on 10/28/20.
10/28/20 Trial Day 3 Wednesday: State witnesses: Jana Loomis-Smith (sister). Kenda Machorro (last person known to see Jody). One of those witnesses, Walter Morris, then 33, died months before the case went to trial. A prosecutor & a defense attorney questioned him last year in a deposition, and a video recording of Morris’ gravelly voice was played for jurors. Cathy Gogal Lenac (gf of Morris). (Morris & Lenac found Jody in the Mill Creek area in Aug. 1972). Linda Hook (neighbor). Witness testimony is expected to continue next week. Judge David Kurtz told jurors the trial is on schedule for jury deliberation to begin by the second week of November. Trial continues on 10/29/20.
10/29/20 Trial Day 4 Thursday: The state’s case moved to testimony from detectives, evidence room supervisors * coroner’s office personnel, who detailed how evidence – including pieces of the victim’s clothing & autopsy photos – was collected, handled, and stored. Pieces of this evidence were removed from the storage bags & presented as exhibits in the courtroom. This testimony told the story of how over the years the physical evidence from this case was moved from the original evidence room in the old Everett JC Penney building on Colby to a different facility on the county administrative campus, and how parts of the evidence log – the record of who had checked out & examined pieces of evidence – went missing & remain so to this day. On cross examination, the defense seized on this to point out that it opens the possibility that some of the evidence might have been compromised, and requested that it be excluded, a request that Judge Kurtz denied. Trial continues on 10/30/20.
10/30/20 Trial Day 5 Friday: Testimony included additional information from detectives & others who examined the evidence over the years. The final witness on Friday was the DNA analyst who prepared the most recent DNA profile from the sample extracted from the victim’s boot. Further testimony scheduled for next week will come from additional DNA analysts involved in extracting the crime scene sample & other samples (for example, that of Thomas Morris) pertinent to the case. It will also include evidence from recorded jailhouse phone conversations made by the defendant while he was incarcerated. Proceedings will resume at 9 am Monday, Nov. 2 when the state will continue presenting its case. The trial will likely last at least through the end of next week & could take longer.
